Merrimack Mom Ordered to Return to Jail

Melissa Gutierrez's bail was revoked by a judge Friday morning.

 A judge ruled Friday to revoke the bail of Melissa Gutierrez after she was arrested twice in September, according to an article on WMUR.com.

Gutierrez, 26, of 46 Wilson Hill Road, was arrested twice in Manchester in September, according to an article in the Union Leader, the first on Sept. 14 on a charge of theft by unauthorized taking and the second on Sept. 28 for driving after suspension, a second offense.

Gutierrez, who was out on bail on charges of negligent homicide and manslaughter, was placed on house arrest after she was arrested in April for theft and possession of a controlled drug. She was arrested in Salem for shoplifting from Lord & Taylor at the Mall at Rockingham Park.

Following that arrest, a bail revocation hearing was held in Hillsborough County Superior Court. Judge Diane Nicolosi said she was going to give Gutierrez another chance.

“I'm not going to have you held at the house of corrections, I'm going to give you a chance,” Judge Diane Nicolosi said during her ruling. “I'm going to put you on house arrest for a period of time.”

“Let me not have you leave this court without understanding that you cannot do this again,” Nicolosi told Gutierrez. “You've got to stay in treatment. You've got to maintain yourself in a way that will allow you to help your lawyers prepare your case.”

“Yes ma'am, thank you,” Gutierrez replied.

A judge ruled today that Gutierrez is a danger to the community and ordered her to return to jail.

A tweet from the Nashua Telegraph earlier today said her trial for negligent homicide has been tentatively scheduled for February.
