Brookline Sex Offender Accused Of Several Duty To Inform And Registration Charges In Nashua

NASHUA, NH — A sex offender with prior charges in Nashua has been arrested again, according to police.

In late May, police received information accusing Keith Herbert, 47, of Brookline, of being “noncompliant with his registration requirements,” Sgt. John Cinelli, the public information officer and communications division supervisor for the Nashua Police Department, said. The tip accused him of moving out of Nashua and changing his cellphone number and employment, but failing to tell the police, he said.

“Additionally,” Cinelli said, “Herbert failed to complete his required quarterly sex offender registration in May 2025.”

A warrant was issued for his arrest after detectives continued the investigation, he said, leading to three counts of change of registration information-duty to inform-subsequent and one count of duty to report-subsequent, all felonies.

Herbert’s criminal history dates back to the late 1990s when he was accused of conspiracy by Nashua police.

Herbert pleaded guilty to the charge in August 1999 and received a three-and-a-half-to-seven-year sentence, suspended and imposed after a hearing within five years of the date deferred, according to court documents. His sentence was suspended in August 2000.

In May 2007, he was accused of aggravated felonious sexual assault and duty to inform charges in Berlin and burglary in Berlin in August 2007. In November 2007, he pleaded guilty to the charges of duty to inform and burglary and received two sentences of one and a half to three years, with 83 days of time served credit, according to court documents. In June 2008, he pleaded guilty to the sexual assault charge and received a five-to-10-year sentence with one year suspended after participating in a sex offender program.

Herbert was accused of being a habitual offender in Brookline in April 2019 and pleaded guilty to a two-to four-year prison term, which was suspended for three years, plus 60 days of community service, in February 2020.

In Nashua in July 2020, he was accused of duty to inform and pleaded guilty to the charge in December 2021. He received a 12-month sentence, six months of which was suspended.

Herbert was charged again with duty to inform in February 2022, with an offense date in Nashua from June 2021, according to documents. The charge was nolle prossed in April 2022.

Herbert was released on personal recognizance and is due in Nashua District Court on Aug. 26.
