Police: New Evidence Won't Free Former Windham Man

A planning board member behind bars for luring and raping a pregnant woman believes it could exonerate him.

Police say the misfiled DNA test results that have led convicted rapist Jeffrey Gray to seek exoneration will actually strengthen the state's case against the former Salem Planning Board member, according to the Eagle-Tribune.

Gray, 51, is serving seven to 14 years in prison for the felonious sexual assault of a pregnant New York woman he allegedly lured to his home. He has claimed he didn't receive a fair trial because of the misfiled forensic lab report, which he claims also shows his victim was lying on the stand

The Eagle-Tribune has reported, however, that Windham Police Chief Gerald Lewis believes the test will "essentially support our case" and irrefutably prove that the sex between Gray and his victim — which included Gray wearing a diaper and pretending to be a baby before raping her, urinating on her and pretending she was his mother — was far from consensual.

The jury determined the sex wasn't consensual when they convicted him last year. One of the jurors even told Patch that Gray would have been "way worse off" if there had been more physical evidence. The DNA results weren't used at trial because prosecutors weren't aware they existed. 

The 36-year-old victim posted on Craigslist in 2011 that she was looking for a place to live, and Gray agreed to let the woman move into his home in March 2011. 

After three days, the woman alleged Gray raped and held her against her will. The next morning he drove her to Logan Airport for her to return to New York, at which point she reported what she said happened to authorities.

Unused duct tape, used and unused adult diapers, and urine-stained bed sheets and a blanket were among the physical evidence recovered from his home.

Gray will represent himself while arguing for a new trial during a hearing in Rockingham Superior Court. The hearing is currently scheduled for Nov. 14.
