Employee Sues Edison For Nonpayment Of Overtime Wages
The employee alleges the township failed to pay him overtime wages when he worked more than 40 hours a week.
EDISON, NJ — An Edison Township employee has filed a lawsuit against the township, alleging nonpayment of overtime wages.
Dwayne Mayers of Sayreville, worked full-time for the Department of Public Works (DPW) since 2004 and part-time for the Recreation Department since 2005. Meyers is suing the township for failing to pay him for working more than 40 hours a week.
Mayers’ DPW duties included working in the road department performing maintenance and repairs, and his Recreation Department duties included supervising facilities, ensuring safety, performing paperwork, and directing patrons.

From 2017 to 2023, Mayers regularly worked over 40 hours a week, combining full-time hours at DPW and approximately 15 additional hours weekly at the Recreation Department, according to the lawsuit.
In December 2023, Mayers was informed by the Recreation Department management that the township lacked the budget to pay him time-and-a-half wages for overtime hours and would, therefore, be eliminating his position, according to the lawsuit.

“Until that point, Plaintiff was unaware of his entitlement to overtime wages,” the lawsuit alleges. “As a result, Plaintiff is entitled to any and all unpaid overtime wages under the continuing violations doctrine.”
Mayers then began reviewing his pay records and identified significant unpaid overtime wages.
He then complained to the township’s Human Resources representative about the failure to pay him overtime wages.
According to the lawsuit, the township’s “failure to pay overtime wages was knowing, intentional, and without justification.”
Mayers is seeking compensatory damages, punitive damages, attorneys’ fees, costs of suit, pre- and post-judgment interest, and all other relief that the Court deems equitable and just.
Edison Township has not yet filed a response to the suit.
