Gun Ammo Dealer Suing Lacey Township Board Of Adjustment

William Malcolm says zoner's decision violated his Second Amendment rights.

LACEY - A ammunition store owner who says his Second Amendment rights were violated when the Lacey Board of Adjustment turned down his request to sell guns at his Route 9 store has filed suit against the board.

William Malcolm, owner of Jersey Sportsman of 118 S. Main St., filed the suit on Oct. 21. His attorney Stuart Platt said his client's application for a use variance was treated unfairly by the zoning board, according to app.com.

"We have reason to believe that at least one other business was permitted to open without even having to go before the zoning board," Platt said. “We (also) believe that a number of homeowners have received home occupation permits to sell firearms out of their homes.”

Malcolm applied for a use variance in August to sell firearms at his story. The board voted 4 to 3 in favor of the application, but five votes were needed for approval.
