How Affordable Is It?
A group of residents living in Affordable Housing units in Mahwah are facing the 95-5 rule. The regulation states that if a homeowner sells a matured affordable housing unit at market value, he or she would keep the restricted value, and have to give 95% of the difference to the town’s affordable housing trust fund.

The 95-5 rule was instituted in 2004, after the residents purchased their units. But, township officials say the rule is retroactive.
