Matawan Contractor Sentenced to 5 Years for Taking Deposits on Uncompleted Work on Sea Bright Home

Matawan-based contractor John Martocci was given the sentence on Friday at Monmouth Co. Superior Court on two Theft by Deception counts.

A Matawan-based contractor was sentenced to five-years in a New Jersey state prison for taking deposits for work he never commenced or completed, announced Acting Monmouth County Prosecutor Christopher J. Gramiccioni.

John Martocci, 59, was sentenced Friday before Monmouth County Superior Court Judge John R. Tassini on two counts of third degree Theft by Deception. The sentenced imposed will run concurrent to the state prison sentence he is currently serving, Tassini ordered.

In July, Martocci admitted he accepted a $1,800 deposit in November 2013 for the Heating, Ventilation, and Air Conditioning (HVAC) system on a Sea Bright home but never commenced or completed the work and never returned the money.

Martocci also admitted he accepted a $1,411 deposit in January 2014 for a new air conditioning condenser for a victim in Howell but failed to do the work and never returned the money.
