Man Sexually Assaulted Women Who Were Incapacitated: Passaic Officials
Authorities arrested and charged the 45-year-old man the same day the assaults were reported at a residence.

PASSAIC, NJ — Officials have charged a Passaic man with sexually assaulting two women while they were unable to give proper consent.
According to authorities, 45-year-old Marcelo Apaza-Herrera sexually assaulted the women, who were both incapacitated, at a Passaic residence on March 30.
Passaic Police arrested him later that morning, said Chief Luis A. Guzman and Passaic County Prosecutor Camelia M. Valdes in a news release.

Apaza-Herrera faces one count each of the following charges, officials said: First-degree sexual assault, second-degree sexual assault, and third-degree aggravated criminal sexual contact.
The statutes he is charged under indicate he was related to the victims by blood or by marriage, and that he knowingly forced or coerced the victims into sex when he knew they were physically incapacitated.

Apaza-Herrera is in custody at the Bergen County Jail, and records show he also faces a charge related to immigration documents.
