KATONAH, NY — The name of candidate Robert F. Kennedy Jr. has been ordered removed from New York ballots for President of the United States.

Judge Christina Ryba ruled thousands of nominating signatures invalid.

At the heart of the controversy was whether or not the third party candidate actually lived at the Katonah address that he claimed. Late Monday, the court found that he did not, but was a resident of California.

"We will appeal and we will win," Kennedy's campaign said in a statement released after the ruling. "The Democrats are showing contempt for democracy. They aren’t confident they can win at the ballot box, so they are trying to stop voters from having a choice."

If the ruling is upheld, it would not only keep Kennedy off the ballot in New York but could also lead to challenges in other states where he used the Katonah address to gather nominating petition signatures.

Ryba found in her 34-page decision that the rented bedroom Kennedy claimed as his residence in New York was not a "bona fide and legitimate residence, but merely a 'sham' address that he assumed for the purpose of maintaining his voter registration," according to an AP report.

Ryba said evidence submitted in trial showed Kennedy had a "long-standing pattern" of borrowing addresses from friends and relatives so he could maintain his voter registration in New York state while actually residing in California, where he has a home with his wife, "Curb Your Enthusiasm" actor Cheryl Hines, according to the AP.

"The Kennedy team will undoubtedly file desperate lawsuit after desperate lawsuit in the coming days and weeks," Clear Choice Action, the Democrat-aligned political action committee that backed the legal challenge, told the AP. "They will fail, and it will not change the simple truth: he lied, and he’s being held accountable."

Kennedy testified that he moved to California a decade ago to be with his wife, and that he always planned to return to New York.
