Man Who Attacked Taxi Driver in Clinton Hill Indicted For Assault

If convicted, Andrew McElroy, 28, faces up to seven years in prison.

 

A man who attacked a taxi driver on New Year's Day in Clinton Hill, leaving the driver in very serious condition, was indicted on multiple counts of assault, District Attorney Charles Hynes announced Tuesday.

Andrew McElroy, 28, was indicted on two counts of assault in the second degree and one count of assualt in the third degree for punching cab driver Key Kim, knocking him unconscious.  If convicted, McElroy faces up to seven years in prison.

The indictment charges that as Kim was driving McElroy to his destination at Willoughby Avenue and Skillman Street, the two men got into an argument about the fare.

When they reached the destination, McElroy and Kim got out of the cab and McElroy punched Kim more than once, knocking him into the concrete sidewalk, the indictment charges.

Two witnesses called police and identified McElroy when police arrived at the scene. Kim was taken to Kings County Hospital with multiple fractures to the skull and bruising and swelling to the brain.

Kim remains in very serious condition at Kings County Hospital where he underwent surgery for his injuries.

An indictment is an accusatory instrument and not proof of a defendant’s guilt.
