Felony DWI Arrest With 1-Year-Old In Car On I-95 In Westchester: NYSP

The Bronx man who was arrested on the New England Thruway had a BAC of .14 percent, according to New York State troopers.

VILLAGE OF MAMARONECK, NY — A traffic stop in Westchester County led to a string of felony charges against a Bronx man, according to state troopers.

New York State Police say that troopers from New Rochelle pulled over a 2018 Mercedes-Benz traveling south on I-95, in the Village of Mamaroneck, on Monday, around 1:58 a.m.

While interviewing the driver, identified as 33-year-old Marvin X. Gallardo, troopers said they noticed signs of intoxication. They administered standardized field sobriety tests, which Gallardo failed, according to NYSP.

A one-year-old child was found in the vehicle at the time of the stop, police said.

Gallardo was arrested and taken to New Rochelle for processing, where he consented to a breath test showing a 0.14 percent BAC.

State police say that further investigation found that Gallardo had a prior DWI conviction in 2017.

He was charged with felony aggravated driving while intoxicated with a child passenger (Leandra's Law), felony driving while intoxicated (prior conviction), felony driving while intoxicated (per se with prior conviction), and several traffic violations.

Gallardo was issued an appearance ticket returnable to Mamaroneck Village Court on May 15.
