No Criminal Charges For NYPD Sgt. In Deadly LI Crash: AG
A woman was killed after getting struck by three vehicles on March 10, 2023.
MASSAPEQUA PARK, NY — New York Attorney General Letitia James released a report on Monday about the death of a woman in Massapequa Park two years ago following a series of car collisions.
One crash on March 10, 2023 involved an off-duty NYPD sergeant. Lynn Walsh died from her injuries a week later.
The Attorney General's Office of Special Investigation (OSI) determined a prosecutor would not be proven beyond a reasonable doubt that the sergeant committed a crime, therefore criminal charges are not warranted.

The OSI used interviews, legal analysis and review of body-worn camera footage to complete the report.
Walsh was struck by three cars in succession while she was in the pedestrian crosswalk on Sunrise Highway at the intersection with Unqua Road.

The second vehicle that hit Walsh was driven by the off-duty sergeant, who approached the intersection with a green light. The car in front of him abruptly stopped, according to the OSI report.
The sergeant swerved out of his lane to avoid hitting the stopped car and struck Walsh, who was in the crosswalk. The sergeant pulled over to attempt to help Walsh, but she was then struck by a third car, as detailed in the OSI report.
Additionally, the sergeant was administered a preliminary breath test within an hour of the collision, and there is no reason to believe that he was impaired by drugs or alcohol or that he was otherwise distracted at the time of the crash, the OSI's report said.
The sergeant did not consciously disregard a substantial and unjustifiable risk of death, the OSI concluded.
