Nassau Man Sues CVS For Revealing Viagra Prescription To Wife

The man's lawsuit alleges that the secret of his little blue pill caused big problems for their marriage.

A man from Merrick has filed a lawsuit against CVS alleging that the pharmacy violated the privacy sections of HIPAA by telling his wife about his Viagra prescription, which has since caused a rift in their marriage.

According to the lawsuit he filed, on June 6, 2017, Michael Feinberg brought his prescription for eight 100 mg Viagra tablets to the CVS at 2291 Merrick Road in Merrick, and asked that it not be put on his insurance, saying he wanted to pay for the medicine himself.

However, when his wife called a few days later to check on one of her own prescriptions, the pharmacist spilled the beans, the lawsuit says, and violated his privacy under the Health Insurance Portability and Accountability Act, commonly called HIPPA.

Because his wife found out about the prescription, Feinberg alleges that his marriage has broken down, "causing him severe mental anguish, pain and suffering and caused him to incur damages," the suit reads.

Feinberg is seeking compensatory and punative damages, but does not outline a specific amount.
