Harvey Weinstein To Stay In NY Until NYC Retrial On Sex Crimes: DA
The conviction was overturned due to a Manhattan judge admitting testimony from three women who accused the producer of sexual misconduct.
NEW YORK CITY — Harvey Weinstein will remain in custody in New York until his retrial on sex crimes charges in Manhattan, before he is returned to California to serve out his sentence, prosecutors announced.
“Today, defendant Harvey Weinstein was formally arraigned on a governor’s warrant issued by Governor Kathy Hochul, who exercised her authority for him to remain in New York State until his case in New York County is adjudicated,” Queens District Attorney Melinda Katz said. “He will serve the California sentence first, as it is now his primary sentence.”
In April 2024, one of Weinstein's convictions was overturned after a majority of judges found that a Manhattan judge in Weinstein's 2020 trial erroneously admitted testimony from three women who accused the producer of sexual misconduct, Patch previously reported.

Weinstein was sentenced to 16 years in prison for another conviction in Los Angeles. He's currently in Mohawk Correctional Facility, where he was expected to serve the 23-year sentence that the New York judges overturned.
Weinstein has denied that he raped or sexually assaulted anyone.

A tentative retrial date has been scheduled for November 12.
