Special Counsel Drops Jan. 6 Charges Against Trump

In July, The Supreme Court ruled Trump had presidential immunity​​ for some of the acts he committed.

NEW YORK CITY — The four federal charges against President-elect Donald Trump related to his attempts to overturn the 2020 election that lead to the Jan. 6 attack on the U.S. Capitol will be dropped, according to Special counsel Jack Smith.

Smith filed the motion on Monday and wrote that it's "seeking to dismiss the charges, in line with the Justice Department’s longstanding position that it can’t charge a sitting president," according to a court filing obtained by NBC News.

"That prohibition is categorical and does not turn on the gravity of the crimes charged, the strength of the Government’s proof, or the merits of the prosecution, which the Government stands fully behind," Smith added.

In July, The Supreme Court ruled Trump had presidential immunity for some of the acts he committed.

Trump was indicted on conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, obstruction of and attempt to obstruct an official proceeding and conspiracy against rights back in August 2023.

He pled not guilty in the case.
