Cops: Man Accused as Repeat Drunken Driver

Pomona man stopped for driving erratically on Route 59 was convicted of DWI in July.

A Pomona man who was convicted of drunken driving in July is again accused of drunken driving after he was seen driving erratically on Route 59 early Sunday, according to Clarkstown police.

Police said a town officer stopped Eric Rodriguez, 26, of Pomona as he was driving westbound in West Nyack at about 12:10 a.m. Sunday. Rodriguez was administered a field sobriety test and was then taken to police headquarters in New City, where police said Rodriguez failed a chemical breath test for alcohol.

Rodriguez was charged with felony driving while intoxicated after Clarkstown police discovered he had been convicted of DWI in July. In New York, a second DWI offense within 10 years is a felony, with stiffer penalties than a first offense.
