Brothers Charged After Cop Shooting In Queens Road Rage Brawl: NYPD

QUEENS, NY — A pair of brothers face assault charges in the Queens road rage brawl that saw an off-duty NYPD officer shot during a struggle for his gun, reportedly captured on video, police said.

Shawn Rivera, 27, and Edwin Rivera, 32, faced arraignment Thursday on a long spate of charges linked to the road rage fight with an off-duty cop on Queens Boulevard and 70th Street — a skirmish captured on video first reported by the New York Post.

The cop held the brothers at gunpoint after one of them smashed his window, the video shows.

"Shoot me," one brother can be heard defiantly shouting on the video published by the Post.

Later, as one brother holds the cop in a chokehold after the officer holstered his gun, the man can be heard saying, "We didn't do nothing."

Two gunshots can be heard on the video a short time later as the three men scuffle on the ground.

The off-duty cop crossed paths with the brothers on Queens Boulevard service road, where he pulled up next to a white minivan he couldn't immediately get around, officials said.

He eventually drove around the minivan, but not after a confrontation that apparently drew the brothers' ire, police said. Edwin Rivera later caught up with the cop, while his brother Shawn ran up and smashed the officer's window, authorities said.

The confrontation prompted the cop to pull his gun, which is where the video beings.

"I'm tougher than you, you tried to run me over," one brother can be heard saying on the video.

Police officials said the cop eventually holstered his gun and tried to hold one of the brothers, which sparked a scuffle for the gun and the officer in a chokehold.

The officer suffered a gunshot wound to the left leg while Edwin Rivera was shot in the hand, the Post reported.

Both brothers face charges of assault, attempted criminal possession of a weapon and obstructing government administration, police told Patch.

Shawn Rivera faces additional charges of strangulation and criminal mischief, stemming from the chokehold and the window smashing, police said.
