Vape Shop Sues Islip After Being Ordered To Relocate

The Islip Zoning Board ruled that the vape shop must find a new home—and now the shop is suing the town.

A Sayville Vape Shop that was ordered by the Town of Islip to move from its Main Street location is suing the town.

BlackWaterVapor is claiming in a lawsuit that the Islip Board of Zoning Appeals incorrectly applied a town ordinance when ruling that the shop must relocate, according to the lawsuit.

Last month, the ZBA ruled that the shop has 99 days to relocate because it does not abide by an adult use law regulates businesses such as adult theaters, massage parlors and strip clubs, prohibiting the from being within 500 feet of churches, homes and parks.

The town's 2016 law-change included vape stores in the same category as the prohibited businesses - even though the store was opened in 2015.
