'Stumble Inn' Sued By Woman Who Stumbled

A woman who fell down a flight of stairs at the "Stumble Inn" claims the business failed to safely maintain the staircase.

UPPER EAST SIDE, NY — A woman is suing the appropriately-named Upper East Side bar called The Stumble Inn after falling down a flight of stairs leading to the bar's bathroom, according to a lawsuit filed this week in Bronx Supreme Court.

Bronx-resident Diana Ortiz visited The Stumble Inn on Oct. 19 2018, to meet up with a friend for a drink, according to the lawsuit. Ortiz claims finished one drink and then headed to the bar's bathroom before leaving the business.

Ortiz's path to the bathroom led to her to a dimly-lit staircase with no sign informing customers to watch their step, according to the lawsuit. While traversing the staircase, she slipped and fell about 10 steps, according to the lawsuit.

The lawsuit describes conditions in the staircase as: "negligently designed, maintained and/or repaired."

"[Ortiz] was caused to fall and be injured while lawfully present at the premises/THE STUMBLE INN due to the aforesaid premises/interior stairway's dangerous, defective, hazardous, unsafe, uneven, broken, worn, poorly maintained, dilapidated, inadequately illuminated and/or excessively slippery condition(s) with a tripping/slipping hazard(s) present thereat," the lawsuit reads.

The Bronx woman suffered serious injuries that required her to get back surgery this year. Ortiz is expected to incur future medical expenses and hospital visits related to the injury, according to the lawsuit. The lawsuit describes some of the woman's injuries as "permanent in nature and duration."

In an interview with the New York Post the woman acknowledged the irony of suffering a debilitating fall at the bar, saying that her brother laughed at her when she told him about the injury.
