Man Pleads Guilty to Sexual Misconduct in Rape Case
Kevin Gonzalez allegedly had sexual relations with a 14-year-old girl.
A man accused of rape on Saw Mill River Road entered a guilty plea to sexual misconduct in Town Court Thursday night.
Kevin Gonzalez, 21, of Yorktown, is accused of having sexual relations with a 14-year-old girl. He was arrested back in January after the mother reported her daughter had been sexually assaulted by a man she knew at a Yorktown residence in December.
An investigation showed that Gonzalez had sexual intercourse with the girl.

When asked by the District Attorney, Jennifer Lowry, if he was entering a plea of guilty voluntarily, Gonzalez said yes.
"Are you entering a plea of guilty because you are in fact guilty," Lowry asked.

"Yes," Gonzalez said.
By pleading guilty, Gonzalez gives up his right to a trial and facing the victim in court.
Town Justice Ilan Gilbert ordered Gonzalez to appear back in court on Aug. 26 and informed him that if he does not show up, cooperate or gets into trouble before then, he would be go to jail for a year. In the meantime he was the subject of a six-year order of protection.
"This was a negotiated plea between the District Attorney's Office and my client through me which both sides found acceptable," said Charles Rubenstein, the defendant's attorney.
