Lawsuit Filed In Deadly Bensalem Hit-And-Run
The 38-year-old Bensalem man's family is suing the driver, his mother and the mother's employer, which owned the vehicle used in the crash.
BENSALEM, PA — The family of a Bensalem man killed in an apparent hit-and-run in August is suing the driver accused in his death, as well as the company that owned the vehicle he was driving.
Timothy McGuire, 38, was on foot along Hulmeville Road at about 2:30 a.m. when he was hit by a vehicle, according to police. Officers weren't called until about 6 a.m., when a passerby noticed his body alongside the roadway.
Richard McCausland, 21, also of Bensalem, is charged with homicide by vehicle, aggravated assault, causing a deadly accident while not properly licensed and speeding during a deadly accident in the death.

McGuire's family filed suit on Wednesday, claiming that McCausland was under the influence of alcohol in his mother's company car when he hit McGuire. His license was suspended at the time and he was driving roughly 75 m.p.h. in a 35 m.p.h. zone, according to the lawsuit.
The suit also names his mother, Wendy Hibbs, and the company that owns Maid Brigade of Bucks County, her employer.

"We believe Timothy McGuire lost his life due to the recklessness and flagrant irresponsibility of this driver, who struck our client, then left him to die by the side of the road," said Clancy Boylan, on of the family's lawyers. "He should never have been behind the wheel that night. We’re grateful for the community support and good police work that allowed the driver to be identified and charged in this tragic case. But, for Timothy McGuire’s family, there are no answers. They must live with the heartbreak of loved one’s needless horrible death."
Maid Brigade did not immediately reply to a message seeking comment for this story Wednesday afternoon.
