According to court records, the victim and her brother went to McCunney's home to visit a friend. While her brother and his friend were in a bedroom with the door closed playing video games, the victim told police she was sexually assaulted by McGunney in the living room of the house.

The now 17-year-old victim told police that she never told anyone about the encounter because she was afraid her mother would be mad at her for what happened, court records say.
