DELAWARE COUNTY, PA — A new lawsuit alleges Delaware County officials ignored the inappropriate behavior former Emergency Services Director Timothy Boyce has been accused of.

Boyce, 60, of Drexel Hill, was fired from the role in May after being charged with indecent assault, simple assault, and harassment.

According to the Pennsylvania Attorney General’s Office, Boyce called an employee to his office and kissed her on Jan. 30. When the employee pulled away and started to leave the office, Boyce then grabbed her buttocks and made a lewd comment, according to the AG’s office.

Then in June, a lawsuit claimed sex and age discrimination in the department under Boyce's leadership.

And then in August, Boyce was charged again, this time with one count of each of indecent assault without consent of others and harassment. Authorities alleged Boyce showed explicit photos of himself to a woman, lifted her dress exposing her underwear, and made numerous sexual comments.

Now, Fox 29 reports the new suit alleges county and other officials failed to protect women in the emergency services department.

According to the Delaware County Daily Times, the suit claims the county "had unconstitutional customs and policies of deliberately ignoring and failing to investigate Boyce’s misconduct against plaintiff and others before her."

Boyce is free on unsecured bail in his two criminal cases.

He is scheduled to be formally arraigned later this month.
