Murder, Related Charges Dismissed In '19 Pottstown Killing

POTTSTOWN, PA — A Pottstown man who has been confined to county prison since the fall of 2019 who was facing charges relating to a gang related murder is poised to be released after a judge dismissed all charges against him.

Murder and related charges against Elijah Davis were dismissed on Aug. 2, according to court documents and news reports.

Patch reported on the arrest of Davis back in September 2019. The then-18-year-old had been charged in connection with the March 2019 killing of 41-year-old, Keith Robinson, who had been found near the intersection of Walnut and York streets in Pottstown inside his vehicle suffering from multiple gunshot wounds.

Robinson had been rushed to the hospital where he was pronounced dead a short time later, Patch previously reported.

Court papers show that Davis had been facing charges of first-degree murder, conspiracy to commit murder of the first degree, third-degree murder, receiving stolen property and possessing instruments of crime.

The docket sheet in the case shows that Davis was initially held for court on all five charges back in October 2019.

An updated entry on the docket sheet from Aug. 2 shows that all of the charges have been dismissed.

An earlier docket entry shows that Davis’ legal team had filed a petition for writ of habeas corpus; a judicial order granting that motion was filed on Aug. 2, the day the charges were dismissed.

A report on WFMZ 69 News says that authorities have no plans to refile the charges against Davis, and that a trial is set to begin next January for the three other people charged in connection with the case: Jaquan Lee, Kyshan Brinkley and Derrick Goins.
