Mr. Yang's 'Other' Attacker Sentencing Today

Octavio Sandoval is scheduled back in court in West Chester today to learn his fate after pleading guilty to planning and attacking Yong Yang back in January.

Sandoval, 18 at the time of the attack, and Sean Christopher Mitten, of Phoenixville, pleaded guilty to attacking Mr. Yang as he got into his delivery van outside the former Yang's Market back in January. Sandoval, according to his court statements punched Mr. Yang in the face during the attack.  Sandoval was holding a knife in his hand as he punched Mr. Yang in the face during the attack and robbery.

The beating left Mr. Yang blind in his left eye and forced him to eventually close and sell his business.

Sandoval's convicted accomplice was sentenced for his role in the pre-meditated attack last month.

During his sentencing Sean Christipher Mitten and his attorneys argued that Mitten was essentially an unwitting stooge, just along for the ride as Sandoval plotted and carried out the attack. Mitten was 17 at the time of the crime.

Sandoval was 18 when, according to court testimony and charging documents, he planned the attack on his one-time employer in an effort to get money for drugs and alcohol.

Common Please Court Judge Phyllis Streitel said she had to look beyond Mr. Yang's own request that the pair be sentenced to minimum jail time and maximum education when she sentenced Mitten last month.

The same judge is scheduled to sentence Sandoval Tuesday at 1:30 p.m. in the same courtroom in West Chester. Sandoval does not have the same mittigating circumstances Mitten had in his sentencing. Sandoval at 18 was an adult and according to prosecutors he was the mastermind who planned the attack.
