A Richmond woman is charged with drunken driving, second offense, after police say her blood alcohol level tested at .149 and .138.

Richmond Woman Charged With Drunken Driving, Second Offense
Janice K. Dale, 54, of 181 Shannock Hill Road, Richmond, was arrestd at about 8:37 p.m. on Dec. 28 and charged with drunken driving, second offense within five years.

According to police, an officer traveling on Card’s Pond Road near Roy Carpenter’s saw a car driven by Dale swerving, and saw it almost hit a group of mailboxes. A traffic stop was made in the 500-section of Card’s Pond Road.
Police said that while speaking with Dale, she smelled strongly of alcohol and had bloodshot eyes, but denied drinking that night. Police said Dale consented to field sobriety tests, which she failed, at which point she was arrested.

According to police, when Dale arrived at headquarters with officers, she asked why she was there. When police again told her she was arrested and charged with drunken driving, police said she became angry, and said she thought they were giving her a ride home to let her dogs outside.
Police said Dale consented to chemical breath tests. The tests revealed a blood alcohol content of .149 at 9:35 p.m. and .138 at 9:37 p.m.
According to police, Dale was processed and then released at about 11:55 p.m.
Police said that according to their records, Dale was arrested in February 2009 for drunken driving.
According to online records, Dale pleaded no contest at Fourth Division District Court to that drunken driving charge in March 2009.
She was ordered to pay a fine, to surrender her license for three months, and to complete 10 hours of community service and DWI school. Dale complied with these terms and her license was restored in May 2009.
