Town Files Suit Against Site-Ready Materials

The Town of Tiverton filed a lawsuit Monday in Newport County Superior Court against the recently controversial Site-Ready Materials, seeking to permanently stop and penalize alleged violations of town zoning ordinances, reports The Sakonnet Times.

In the lawsuit, the town claims that Site-Ready is engaging in trash recycling and transfer, quarrying, and the composting of yard waste, constituting "a threat to public health, safety, and the general welfare of the citizens of the Town of Tiverton.”

Tiverton requires permits for waste transfer, recycling and composting, however Site-Ready never applied for them. Any quarrying or blasting is explicitly prohibited in Tiverton ordinances.

Site-Ready came under the scruity of residents and local building official Gareth Eames last year when the Eagleville road company submitted an application of approval before the Planning Board for a major facilities expansion.

Marcello Louro denied allegations against his company stating he was in conducting business in violation of town ordinance as recently as the Tiverton Planning Board's Jan. 8 

The lawsuit, according to The Sakonnet Times story, seeks a preliminary and permanent injunction that will stop certain activities, and also a declaratory judgment that those activities are prohibited by town ordinances.

The town seeks to impose penalties against Site Ready of up to $500 per day per violation.
