Administrative Law Judge Carolyn C. Matthews granted a motion Friday to dismiss an appeal of the issuance of a Department of Health and Environmental Control (DHEC) waste water permit by Lexington-Richland 5 board member Kim Murphy, according to a release from District 5.
In a ruling Friday afternoon, Matthews said, “[Murphy’s] claim is devoid of any foundation and therefore fails to state facts sufficient to constitute a cause of action, and it is therefore dismissed.”
This is the second court ruling against Murphy in regards to the Chapin High project, according to the release. In May, the court ruled in favor of the district in another appeal involving a water certificate from DHEC. The court ruling in May can be viewed in the document on the right.

The Chapin High project is one of 10 renovation and construction projects that were approved in a 2008 bond referendum.
will be opened on Nov. 3 at 2 p.m, District 5 Superintendent Dr. Stephen Hefner said at the board's Oct. 24 board meeting. Construction could begin by the end of November.
