The Petersons were watching television early on the morning of August 30, 2014, when the power went out. Charles Peterson went to the garage to check the circuit breaker. His mother heard gunshots and then saw two intruders who forced her from room to room in the house at gunpoint as they stole several items. At one point, she saw an opportunity to escape and ran towards a neighbor's home and was shot as she fled.
In addition to the Peterson robbery, Spivey was convicted of robbing a man at an ATM the same morning.
