Indecent Exposure Charges Filed Against 2 Men In 2 Cases

Two men face multiple charges in two different cases involving indecent exposure, Arlington Police reported.

ARLINGTON, VA — Arlington County Police arrested two men on Saturday on charges in two separate instances of indecent exposure, one in the Ballston area and the other in the Green Valley neighborhood, authorities said.

Officers responded around 2:40 p.m. to the Ballston area for the first report of an exposure.

“Upon arrival, it was determined the female Victim One was walking in the area of Clarendon Boulevard and Washington Boulevard when she observed the male suspect allegedly expose himself before fleeing the scene,” according to police. “Responding officers canvassed the area for the suspect yielding negative results.”

Around 4:46 p.m., police received a report of an assault that just occurred near North George Mason Drive and Washington Boulevard. Victim Two told police she was walking with two children in the area when they saw a man expose himself and then touch her inappropriately, before running off, according to police.

Officers searched the area and located Ivan Fontana, 37, of Arlington, who they say was the suspect in both incidents. Fontana was charged with indecent exposure, sexual battery and indecent liberties with a child, police say.

Around 6:44 p.m. on the same day, an officer was flagged down by a witness who reported seeing a man expose himself inside a business in the 400 block of 23rd Street South, according to police.

“It was determined the male suspect allegedly entered a business, began screaming, threw merchandise and exposed himself before fleeing the scene,” ACPD said.

Searching the area, the officer located the suspect, whom police identified as Amir Haynes Bey, 36, of an undetermined address. Bey was arrested and charged with indecent exposure, disorderly conduct and public intoxication. He was held without bond.

Fontana was scheduled to be arraigned in Arlington County District Court on Monday morning but it was continued to Tuesday morning, according to court documents. A date for his preliminary hearing was not scheduled.

Indecent exposure and sexual battery charges are Class 1 misdemeanors, which are each punishable by confinement in jail for up to 12 months and/or a fine of up to $2,500, according to Virginia law.

Fontana also had an appearance on Monday morning in Arlington County Juvenile and Domestic Court on the indecent liberties with a child charge, which is a more serious offense, according to court records.

A Class 5 felony, Fontana faces a potential penalty of up to 10 years in prison, or, in the discretion of the jury or court, confinement in jail for not more than 12 months and a fine of not more than $2,500, under Virginia law.

The day before he was arrested for indecent exposure, Bey was arrested on a Class 4 misdemeanor charge of public intoxication, according to court records. After being arraigned in Arlington County District Court on Monday, he was released on his own recognizance. His preliminary hearing on this charge was scheduled for June 24.

Bey was arraigned on Monday morning on the misdemeanor charges of indecent exposure, public intoxication, and disorderly conduct and is due back in court on Tuesday morning for a bond hearing, according to court documents. His preliminary hearing was set for July 17.
