Fairfax Man Arrested For Hit And Run Already Has Court Date For 2024 Arrest

FAIRFAX CITY, VA — A 35-year-old Fairfax man is facing three assault on a police officer charges, in connection to a June 10 hit-and-run investigation, according to authorities. The man was already facing similar charges for an incident that occurred in 2024.

Officers from the City of Fairfax Police responded around 1:11 a.m. to the 4000 Block of Maple Street to investigate the report of a hit and run. The officers found two damaged vehicles, one parked and another with someone sitting in the driver’s seat, according to the incident report.

The officers determined that one of the drivers was under the influence of alcohol. When they tried to take the driver into custody, he became aggressive, assaulting two officers and resisting arrest, according to police. No injuries were reported.

Fernando Bozo-Castillo of Fairfax was taken to Fairfax County Adult Detention Center, where he was charged with driving under the influence of alcohol, refusal, hit and run, obstruction, and three charges of assault on a law enforcement officer, according to police. Bozo-Castillo was then held without bond.

On Wednesday morning, Bozo-Castillo was arraigned in Fairfax County District Court and had a bond hearing on Thursday morning, according to court records. His preliminary hearing was set for Aug. 25.

The three assault on law enforcement charges are Class 6 felonies, which can be punished by one-five years in prison or, at the court's discretion, up to 12 months in jail and/or a fine of up to $2,500, according to the Code of Virginia. The other charges are all misdemeanors.

Bozo-Castillo is due to appear in court on Monday when he will face a number of charges stemming from a similar arrest that occurred on April 15, 2024.

Bozo-Castillo faces a felony assault on a law enforcement charge, as well as misdemeanor charges of obstruction of justice/resisting arrest, driving while intoxicated: first offense, and failure to stop at the scene of a crash with damages of more than $500, according to court records.
