2 Restaurants Must Clean, Sanitize Soiled Ice Machines: Inspection

Rappahannock Area Health District inspectors visited 14 food establishments in Fredericksburg recently, finding violations at five of them.

FREDERICKSBURG, VA — Rappahannock Area Health District inspectors visited 14 Fredericksburg food establishments between Oct. 10-18, finding health code violations at five of them.

Health inspectors reported finding soiled ice machines at two of the restaurants they visited. The person in charge told the inspector that the restaurant wouldn’t use the ice machine until it had been cleaned and sanitized.

“Surfaces of equipment contacting food that is not time/temperature controlled for safety shall be cleaned at a frequency necessary to prevent the accumulation of soil,” the inspector wrote, as a corrective measure for the restaurant.

Enterior of milk dispenser Corrective Actions: Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
  • Observed a long hose attached to a Y connector with a spray nozzle attached to the mop sink in absence of an adequate backflow preventer. During the inspection the sprayer was removed. EHS will provide a handout of backflow preventers. Corrective Actions: Provide the approved backflow or backsiphonage device for the specific application and type of device to prevent contamination of the drinking water system.
  • Observed ceiling tiles missing above the storage of disposable cups and the clean dish rack Corrective Actions: Attach ceiling covering so it is easily cleanable.

  • Observed the outer door of the kitchen propped open for approximately 20 minutes while a produce delivery truck driver organized the delivery before bringing it into the kitchen. As a result, many flies entered the kitchen. The door was closed after delivery was made. Instructed the person in charge to not open the door until product was ready to be brought in. Corrective Actions: Minimize the amount of time doors are open to prevent the entry of pests.
  • The dirty side staging table at the dish machine is not properly sealed to the wall. Corrective Actions: Seal the unit to adjoining equipment or walls since it is exposed to spillage or seepage.

Observations & Corrective Actions

  • The person in charge was unable to provide documentation of training relating to the employee health policy for this facility. Corrective Actions: Ensure training records are kept in a location where they are easily accessible within the establishment.
  • Through discussion with the person in charge the shake machine spindle, which is in contact with the ice cream (contains milk) is sanitized every 4 hours. Wash, rinse and sanitize step is conducted once a day. Instructed the person in charge to wash and sanitize the spindle at least once every 4 hours. Corrective Actions: Food contact surfaces of equipment and utensils must be cleaned and sanitized at least every 4 hours to prevent contamination by bacterial growth.
  • Observed the ice machine to be soiled. The person in charge will not use the unit and will it cleaned and sanitized. Corrective Actions: Surfaces of equipment contacting food that is not time/temperature control for safety food shall be cleaned at a frequency necessary to prevent the accumulation of soil.
  • Observed several tongs and containers to be soiled to the sight and touch. The two items were taken over to the warewashing area to be cleaned. Corrective Actions: Equipment food-contact surfaces and utensils shall be clean to the sight and touch.
  • Time is used as pubic health control method for the deli ham without prior approval from the Health Department. Item was discarded. EHS provided the necessary documents. Corrective Actions: If time without temperature control is used as the public health control for a working supply of time/temperature control for safety food before cooking or for ready-to-eat time/temperature control for safety food that is displayed or held for sale or service, written procedures shall be prepared in advance, maintained in the food establishment, and made available to the department upon request.
  • Observed light showing around the back door and the drive thru window when closed. The person in charge has a work order in for the door and window. Window needs to be self closing. Corrective Actions: Protect the food establishment against the entry of insects and rodents by 1. Filling or closing holes and other gaps along floors, walls, and ceilings, 2. Closed, tight fitting windows, and 3. Solid, self-closing, tight-fitting doors.
  • Observed small flying insects in the front and back of the house. Person in charge has been working with pest control company to try to eliminate pests. Corrective Actions: Insects and other pests are capable of transmitting disease to people by contaminating food and food-contact surfaces. Routinely inspect the premises to control the presence of pests on the premises.
  • Observed single service cups, lids, and straws stored directly near the trash can under the beverage dispensing unit in the front of the house. Corrective Actions: Single-service items shall be stored in a clean, dry location that is not exposed to splash, dust, or other contamination and at least 6 inches off the floor on approved shelving units or dunnage racks. In addition, the single-service items shall be kept in the original protective package or stored by using other means that afford protection from contamination until used.
  • Accumulations of debris were noted on the following non-food contact surfaces: 1) shelving units, 2) exterior of refrigeration units, 3) fryers cabinets, 4) draining board of beverage dispensing unit in the front of the house. Corrective Actions: Clean the surface at a frequency necessary to preclude accumulation of soil residues that become encrusted or attract insects and rodents.
  • Observed the following: 1) a hose stored in the mop sink basin that was attached to a Y connector without an air gap or a back flow prevention device, 2) ice machine connected to the main water line without a backflow prevention device. Corrective Actions: A plumbing system shall be installed to preclude backflow of a solid, liquid, or gas contaminant into the water supply system at each point of use at the food establishment, including on a hose bibb (threaded faucet) if a hose is attached or on a hose bibb if a hose is not attached and backflow prevention is required by law by: 1. Providing an air gap as specified under 12VAC5-421-2200;P or 2. Installing an approved backflow prevention device as specified under 12VAC5-421-2210.
  • Observed floors, walls, and ceiling (to include vents) throughout the facility soiled to include the walk in cooler and freezer. Corrective Actions: Clean the physical facilities at a frequency necessary to ensure the protection and safe preparation of food.
  • Observed the following: 1) several ceiling tiles missing and gaps around conduits in the back of the house. 2) broken floor tiles, 3) several floor tiles need to be regrouted. The person in charge will get the ceiling tiles replaced and gaps filled in, some of the drink mix lines were recently replaced. Corrective Actions: Repair the physical facilities. Poor repair and maintenance compromises the functionality of the physical facilities.
  • Observed vents throughout the facility heavily soiled. Corrective Actions: Clean intake and exhaust air ducts at regularly intervals to prevent them from becoming sources of contamination.

  • A food employee was observed on their phone then donned gloves and engaged in food preparation. Employee was instructed to wash their hands. Corrective Actions: Instruct food employees to clean their hands and exposed portions of their arms immediately before engaging in food preparation including working with exposed food, clean equipment and utensils, and unwrapped single-service and single-use articles and during food preparation, as often as necessary to remove soil and contamination and to prevent cross contamination when changing task.
  • Observed food in the grab and go area in the front of the house that was not properly labeled. Corrective Actions: Food packaged in a food establishment for customer self service shall include labels that contain the following information: 1. the common name of the food, 2. the list of major ingredients including artificial colors or preservatives, 3. the total net weight or quantity of the food, 4. the name and place of business of the food manufacturer, packer, or distributor, 5. the name of the food source for each major food allergen contained in the food,6. nutrition labeling and, 7. for any salmonid fish containing canthaxanthin as a color additive, the labeling of the bulk fish container, including a list of ingredients, displayed on the retail container or by other written means.
  • No quaternary ammonium (QA) test kit available in order to accurately monitor the concentration for the QA sanitizer solution used for warewashing. Corrective Actions: Obtain a quaternary ammonium (QA) test kit in order to accurately monitor the QA sanitizer solution used for warewashing.
  • A back flow prevention device must be installed on the ice machine that is directly connected to the main water line. What Violations Do VDH Inspectors Report?

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation.Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.

The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
