Fresh Fish Kept Improperly At Fredericksburg Restaurant: Inspections

Between Nov. 4-15, Rappahannock Area Health District inspectors found health code violations at 16 Fredericksburg restaurants.

FREDERICKSBURG, VA — Rappahannock Area Health District inspectors visited 28 Fredericksburg food establishments between Nov. 4-15, finding health code violations at 16 of them.

At one food establishment, an inspector noticed fresh raw trout inside a vacuum sealed bags in the walk-in cooler. Talking to the person in charge, the inspector learned that the raw trout comes in fresh and the facility vacuum seals them in bags, which are stored in the walk-in cooler.

"Except for fish that is frozen before, during, and after packaging and bears a label indicating that it is to be kept frozen until time of use, a food establishment may not package fish using a reduced oxygen packaging method," the inspector wrote in their report.

  • The person in charge was unable to provide written procedures for the clean-up of vomiting and diarrheal events. A sample copy was provided to the person in charge. Corrective Actions: Provide a written plan for employees to follow when responding to a vomiting or diarrheal events with discharge of vomitus or fecal matter onto food surfaces that includes the procedures for cleaning and sanitizing affected areas, disposing of the discharge and contaminated food items, and protecting employees while they respond to a vomiting or diarrheal event.
  • The metal shield/deflector plate inside of the ice machine and the can opener blade were both soiled. Corrective Actions: Surfaces of utensils and equipment contacting food that is not time/temperature control for safety food shall be cleaned at a frequency specified by the manufacturer or absent manufacturer specifications, at a frequency necessary to preclude accumulation of soil or mold.
  • The cutting boards at both prep coolers were soiled. Corrective Actions: Equipment food-contact surfaces and utensils shall be clean to sight and touch.
  • The following items were holding above 41°F in the prep table next to the hot holding area: 1. one large container of coleslaw holding at 51°F; 2. one large plastic container half full of shredded parmesan cheese holding at 53°F; 3. one small stainless-steel container of diced tomatoes holding at 50°F; and 4. one small stainless-steel container of sliced tomatoes holding at 51°F. In the one door reach-in cooler near the cook line there was also one large plastic container, half full, of chicken wings holding 44-46°F. All items were held overnight and had not been taken out the day of the inspection. All items were voluntarily discarded. Corrective Actions: Time/temperature control for safety food shall be maintained at 41°F.
  • The following non-food contact surfaces were soiled: 1. the outside of the dish machine; 2. the outside of reach-in coolers and freezers; 3. the wire shelving near the ware washing area; 4. the prep tables near the cook line; and 5. the up splash of the drink machines. Corrective Actions: Non-food contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues.
  • Observed the floors and walls throughout the facility soiled. Corrective Actions: The physical facilities shall be cleaned as often as necessary to keep them clean.

Corrective Actions: The Consumer Advisory shall include a disclosure statement that includes a description of the animal-derived foods and identification of the animal-derived foods by astericking (*) them to a footnote that states that the items are served raw or undercooked, or contain raw or undercooked ingredients.
  • Observed inside the walk-in cooler fresh raw trout inside vaccuum sealed bags . Through discussion with the person in charge the raw trout comes in fresh and facility vaccums seals in bags and stores in walk-in cooler. During the inspection the trout was voluntarily discarded. EHS will email the person in charge regulations for Reduced Oxygen Packaging.
  • Corrective Actions: Except for fish that is frozen before, during, and after packaging and bears a label indicating that it is to be kept frozen until time of use, a food establishment may not package fish using a reduced oxygen packaging method.
  • Observed the following wood food contact surfaces no longer sealed and cleanable: 1. Two spoons 2. Three cutting broads 3. Two serving trays. Corrective Actions: Materials that are used in the construction of utensils and food-contact surfaces of equipment shall not allow the migration of deleterious substances or impart colors, odors, or tastes to food and under normal use conditions shall be finished to have a smooth, easily cleanable surface.
  • Observed eight plastic cutting broads heavily scored and stained . During the inspection cutting broads were discarded. Corrective Actions: Multiuse food-contact surfaces shall be: 1) smooth, 2) free of breaks, open seams, cracks, chips, inclusions, pits, and similar imperfections, 3) free of sharp integral angles, corners, and crevices, 4) finished to have smooth welds and joints, and 5) accessible for cleaning and inspection. Cleaning and inspection shall be completed by one of the following methods: (a) without being disassembled, (b). by disassembling without the use of tools, or (c) by easy disassembling with the use of handheld tools.
  • The person in charge was unable to provide chlorine test strips for the dishwashing machines. During the inspection the person in charge ordered the test kit and provided a invoice. Corrective Actions: The operator shall be monitoring the concentration of the sanitizing solution using a test kit or other device.
  • Observed the following non food contact surfaces in need of cleaning: 1. Interior & Exterior of Hot holding unit 2. Shelving. Corrective Actions: Clean the surface at a frequency necessary to preclude accumulation of soil residues that become encrusted or attract insects and rodents.
  • Observed numerous pans and pots heavily encrusted on the non food contact surface. Corrective Actions: Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.

Corrective Actions: A certified food protection manager is required when offering raw meat, poultry, and fish on the menu.
  • Observed both ice machines in need of cleaning. The person in charge will unplug the ice machine to drain it and clean it. Ice machine won't be used until it is cleaned. Corrective Actions: Surfaces of utensils and equipment contacting food that is not time/temperature control for safety food shall be cleaned at a frequency specified by the manufacturer or absent manufacturer specifications, at a frequency necessary to preclude accumulation of soil or mold. To include equipment such as ice bins and beverage dispensing nozzles and enclosed components of equipment such as ice makers, cooking oil storage tanks and distribution lines, beverage and syrup dispensing lines or tubes, coffee bean grinders, and water vending equipment.
  • Observed the following time temperature control for safety (TCS) foods cold holding at improper temperatures overnight in the prep unit across from the grill: 1) cut tomatoes (43 degrees F), 2) a plastic container of raw chicken (44 degrees F), 3) a container of diced tomatoes and onions (44 degrees F), 4) a container of cut lettuce (50 degrees F), 5) a container of cooked chicken wings (53 degrees F). Items were discarded (corrected on site). Corrective Actions: Cold hold potentially hazardous food at 41°F or below to inhibit the growth of harmful bacteria.
  • Observed several of the cooling units without temperature measuring devices. The person in charge ordered the thermometers during the inspection. Corrective Actions: In a mechanically refrigerated or hot food storage unit, the sensor of a temperature measuring device shall be located to measure the air temperature or a simulated product temperature in the warmest part of a mechanically refrigerated unit and in the coolest part of a hot food storage unit.
  • No thin-probed food thermometer available. The person in charge ordered a thermometer during the inspection. Corrective Actions: Obtain a thin-probed food thermometer.
  • Observed floors ,walls, and ceiling throughout the facility in need of cleaning (to include under equipment). Corrective Actions: All floors, walls, and ceilings must be cleaned as often as necessary to keep them clean. Cleaning of the physical facilities is an important measure in ensuring the protection and sanitary preparation of food. A regular cleaning schedule should be established and followed to maintain the facility in a clean and sanitary manner.

  • There is no one with a certified food protection manager certification. The person in charge and one of the workers will enroll in a class. Corrective Actions: At least one employee with supervisory and management responsibility and the authority to direct and control food preparation and service shall be a certified food protection manager, demonstrating proficiency of required knowledge and information through passing a test that is part of an accredited program.
  • The person in charge was unable to provide written procedures for the clean-up of a vomiting or diarrheal event. A sample copy was provided to the person in charge. Corrective Actions: A food establishment shall have written procedures for employees to follow when responding to vomiting or diarrheal events that involve the discharge of vomitus or fecal matter onto surfaces in the food establishment. The procedures shall address the specific actions employees must take to minimize the spread of contamination and the exposure of employees, consumers, food, and surfaces to vomitus or fecal matter.
  • There were dishes in the handwashing sink in the ware washing area and there were ketchup packets in the front handwashing sink. All items were removed from the sink. Corrective Actions: A handwashing sink shall be maintained so that it is accessible at all times for employee use.
  • There was no soap at either handwashing sink. Soap was put in the dispenser for each handwashing sink. Corrective Actions: Each handwashing sink or group of two adjacent handwashing sinks shall be provided with a supply of hand cleaning liquid, powder, or bar soap.
  • There were two small open bags of fries sitting in a stainless-steel container on top of an opened package of raw bacon. The bags of fries were voluntarily discarded. Corrective Actions: Food shall be protected from cross contamination by separating raw animal foods during storage, preparation, holding, and display from raw ready-to-eat food including other raw animal food such as fish for sushi or molluscan shellfish, or other raw ready-to-eat food such as fruits and vegetables.
  • The inside of the microwave is soiled. Corrective Actions: The cavities and door seals of microwave ovens shall be cleaned at least every 24 hours by using the manufacturer's recommended cleaning procedure.
  • There is a system for date marking, but none of the prepared foods in the reach-in cooler were date marked after being held for more than 24 hours. Corrective Actions: Refrigerated ready-to-eat time/temperature control for safety food prepared and held in a food establishment for more than 24 hours shall be clearly marked to indicate the date or day by which the food shall be consumed on the premises, sold, or discarded when held at a temperature of 41°F (5°C) or less for a maximum of seven days. The day of preparation shall be counted as day 1.
  • There was a large number of crawling insects dead on glue traps throughout the facility and on the floor in the freezer storage room. Corrective Actions: Dead or trapped birds, insects, rodents, and other pests shall be removed from control devices and the premises at a frequency that prevents their accumulation, decomposition, or the attraction of pests.
  • Live crawling pests were observed in the ware washing area on the floor and on the shelving. Corrective Actions: The presence of insects, rodents, and other pests shall be controlled to minimize their presence on the premises by: 1. Routinely inspecting incoming shipments of food and supplies; 2. Routinely inspecting the premises for evidence of pests; 3. Using methods, if pests are found, such as trapping devices or other means of pest control as specified under 12VAC5-421-3360, 12VAC5-421-3440, and 12VAC5-421-3450; and 4. Eliminating harborage conditions.
  • The reach-in freezer has a lot of ice build-up. The pipe under the rinse basin of the 3-compartment sink is leaking. One fryer is not working. The person in charge has already called a repair person to fix the sink and the fryer. The person in charge will take care of the ice in the freezer. Corrective Actions: Equipment shall be maintained in a state of repair and condition that meets the manufacturer's requirements.
  • There was no sanitizer available when I started the inspection. The person in charge went out and brought back bleach to be used as sanitizer. Corrective Actions: Except for chemical sanitizers that are generated on site at the time of use, chemical sanitizers that are used to sanitize equipment and utensils shall be provided and available for use during all hours of operation.
  • The outside of equipment and shelving throughout the facility is soiled. The shelving inside of the reach-in cooler is soiled. The area around the mop sink is soiled. Corrective Actions: Non-food contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues.
  • The walls and floors throughout the facility are soiled. There is a large build-up of grease and some food debris behind the fryers, flat top grill, and range. Corrective Actions: The physical facilities shall be cleaned as often as necessary to keep them clean.
  • There is one light fixture in the kitchen and one light fixture in the freezer storage area that have fluorescent bulbs and do not have shields. Corrective Actions: Light bulbs shall be shielded, coated, or otherwise shatter-resistant in areas where there is exposed food; clean equipment, utensils, and linens; or unwrapped single-service and single-use articles.

  • Through discussion with a food employee food thermometers are being washed with soapy water only, absence of a sanitization step. Informed employees the food thermometers are required to be washed, rinsed and sanitized at least once every 4 hours when being used. Demonstrated cleaning and sanitization of the food thermometer. Corrective Actions: Food contact surfaces of equipment and utensils must be cleaned and sanitized at least every 4 hours to prevent contamination by bacterial growth.
  • Observed tray of corn dog bites (116 degrees F) and chicken tender bites (116 degrees F) hot holding at improper temperatures inside a hot holding cabinet. A food employee reported foods have been in the unit for 1.5 hours. Temperature of the hot holding unit was observed at 142 degrees. Facility uses time for quality and discards after 2 hours (timer is used to monitor time). Recommended using time as a public health control and will email the operator documentation. Corrective Actions: Hot hold potentially hazardous food at 135°F or above to inhibit the growth of harmful bacteria.
  • Observed food employees without hair and beard restraints. Corrective Actions: Food employees shall wear hair restraints such as hats, visors, hair nets or beard nets to effectively keep their hair from contacting exposed food, clean equipment, utensils, linens, and unwrapped single-service items. This section does not apply to food employees such as counter staff who ONLY serve beverages and wrapped or packaged foods, hostesses, and wait staff.
  • Observed 2 wet wiping cloths in the 3 compartment sink basins. During the inspection the person in charge discarded them. Corrective Actions: Ensure wet wiping cloths are stored in a chemical sanitizer at the proper concentration between use.
  • Upsplash of both popcorn poppers require cleaning. Corrective Actions: Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
  • Observed missing lids on the right dumpster and broken lid on the left dumpster, preventing closure. Recommend contacting contractor to replace refuse containers. Corrective Actions: Storage areas, enclosures, and receptacles for refuse, recyclables, and returnables shall be maintained in good repair.
  • Observed the following in need of cleaning: Ceiling tiles above the front counter, 2 soiled absorbent ceiling tiles in dry storage and dusty air vents above the 3 compartment sink.   • Observed one can of Hot Shot Flying Insect spray and one can of Raid Multi-insect spray on the wire shelving rack across from the three-compartment sink. The cans will be removed from the facility. They cannot be used in food service areas. Corrective Actions: Poisonous or toxic materials shall be used according to manufacturer's use directions included in labeling, and, for a pesticide, manufacturer's label instructions that state that use is allowed in a food establishment.

What Type Of Violations Do Inspectors Report?

Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.

Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation.Sometimes these are simple, and violations can be corrected during the course of the inspection.

Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.

The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
