Health Code Violations Found At 10 Fredericksburg Restaurants
Rappahannock Area Health District inspectors found violations at 10 of the 30 Fredericksburg food establishments they visited March 10-21.

FREDERICKSBURG, VA — Rappahannock Area Health District inspectors reported finding a combined 24 violations at 10 of the 30 Fredericksburg food establishments they visited between March 10-21.
In one kitchen, an inspector reported finding the temperatures of Dannon Light & Fit yogurt, Yoplait strawberry banana yogurt and whipped cream cheese kept in the reach-in cooler to be higher than 43 degrees and above. To prevent spoilage or the growth of harmful bacteria, these items needed to be kept at temperatures between 38-42 degrees. All the items were discarded.
At another Fredericksburg restaurant, an inspector bserved overflowing dumpsters and numerous bags of trash on the ground surrounding the dumpster.

Restaurant staff were instructed to store all trash/waste in a dumpster with closed, tight-fitting lids to prevent pest attraction.

- Observed the following items cold holding overnight in the two-door reach-in cooler (RIC) above 41°F: 1) Dannon Light & Fit yogurt 43-45°F (2x24 packs & 13 individuals); 2) Yoplait strawberry banana yogurt 43-44°F (1x24 pack & 17 individuals); and 3) Whipped cream cheese at 44°F (one 1/8 full tub). Corrective Actions: All items were discarded by the person in charge. The temperature of the RIC was lowered from 42°F to 38°F.

- Observed the interior of the ice machine soiled .
- Observed three food employees preparing foods without wearing hair restraints .
- Observed inside the walk-in cooler the following foods improperly stored . 1.Two bags of pre-cooked shrimp and pre-cooked pork ribs stored in grocery bags. 2. Pre-cooked chicken stored on a card broad box EHS discussed with the person in charge using Ziplock bags. During the inspection food was voluntary discarded.
- Observed the following non food contact surfaces in need of cleaning : 1. Exterior of all cooking equipment 2. All Shelving
- Observed at the mop sink a long green hose with a spray nozzel attacted and absent of a dual check backflow preventer .During the inspection the person in charge turned the water off and removed the spray nozzel. EHS provided a handout to the person in charge.

- The person in charge was unable to provide proof that at least one person has a certified food protection manager (CFPM) certificate. Corrective Actions: The person in charge advised one manager is in the process of getting a CFPM certificate.
- Time as a public health control (TPHC) is being used for the following items for the continental breakfast which is 0630-0900: 1) cut melons (47°F); 2) yogurt cups; 3) nonfat milk cartons; 4) hard boiled eggs (shell removed) (56°F); and 5) milk, half & half, and 2% milk for coffee. Corrective Actions: The person in charge advised they do throw all items out after the breakfast service. I recommend putting out less of each item. TPHC form has been filled out by Environmental Health Specialist (EHS) and signed by EHS and the person in charge.
- The person in charge was unable to provide a valid test kit for the quaternary ammonium sanitizer at the tree-compartment sink (QT-40). Corrective Actions: A sample amount of test strips was given to the person in charge to use until a valid test kit is obtained.

Corrective Actions: At least one employee with supervisory and management responsibility and the authority to direct and control food preparation and service shall be a certified food protection manager, demonstrating proficiency of required knowledge and information through passing a test that is part of an accredited program.
- Observed no soap at the handsink. Soap was placed at the handsink. Corrective Actions: Each handwashing sink or group of two adjacent handwashing sinks shall be provided with a supply of hand cleaning liquid, powder, or bar soap.
- Observed water at the hand sink not reaching adequate temperature in the kitchen. Facility called a technician for service. Corrective Actions: A handwashing sink shall be equipped to provide water at a temperature of at least 100°F (38°C) through a mixing valve or combination faucet
- Observed the test strips for chemical sanitizer expired. Corrective Actions: A test kit or other device that accurately measures the concentration in mg/L (ppm) of sanitizing solutions shall be provided and readily accessible for use.

What Violations Do VDH Inspectors Report?
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.
Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
