No Covered Receptacle In Women's Bathroom At 2 Fredericksburg Eateries
Rappahannock Area Health District inspectors found violations at 11 food establishments they visited between Dec. 1-12.
FREDERICKSBURG, VA — Rappahannock Area Health District inspectors visited 20 food establishments in Fredericksburg between Dec. 1-12, finding health code violations at 11 of them.
At two Fredericksburg restaurants, inspectors reported that there were no covered receptacles in the women's bathrooms. Food establishments in Virginia are required to provide covered receptacles in their women's restrooms so female customers can dispose of their sanitary napkins.

- Observed a food employee wash their hands for 10 seconds . During the inspection the food employee wash their hands correctly.(Corrected) Corrective Actions: Educate employees on proper handwashing and routinely monitor the employee's handwashing procedures to ensure they are effectively cleaning their hands.
- Observed absence of hand drying provision at the handwashing sink located in the bar area. During the inspection a employee provided disposable towels. Corrective Actions: Hand drying devices such as individual disposable paper towels, a Continuous towel system that supplies the user with a clean towel or heated air hand drying device must be provided at all hand washing lavatories to encourage proper hand washing and avoid employees to drying their hands on their clothing or other unclean materials
- Observed the following equipment in poor repair: 1. all metal shelving throughout the facility is HEAVILY rusted 2. accumulation of water in one of the glass coolers in the bar area-heavy rust was observed in the bottom surface of the cooler. Corrective Actions: Equipment shall be maintained in a state of repair and condition that meets the requirements.
- Observed card broad and foil lined on shelving in the dry storage area and the cook line. Corrective Actions: Nonfood-contact surfaces of equipment that are exposed to splash, spillage, or other food soiling or that require frequent cleaning shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material.
- Observed numerous plastic cutting broads heavily scored and stained. Corrective Actions: Multiuse food-contact surfaces shall be: 1) smooth, 2) free of breaks, open seams, cracks, chips, inclusions, pits, and similar imperfections, 3) free of sharp integral angles, corners, and crevices, 4) finished to have smooth welds and joints, and 5) accessible for cleaning and inspection. Cleaning and inspection shall be completed by one of the following methods: (a) without being disassembled, (b). by disassembling without the use of tools, or (c) by easy disassembling with the use of handheld tools.
- Observed the following nonfood contact surfaces in need of cleaning: 1. Interior of fryer cabinets 2. Interior of beer cooler in bar area 3. All shelving 4. Exterior of bulk ingredient bins 5. - Observed card broad lined on shevling inside the walk-in cooler. Spice rack shelving is unfinished wood, not a smooth and easily cleanable surface. Corrective Actions: Non-food contact surfaces shall be smooth and easily cleanable.
- Observed the following non food contact surfaces in need of cleaning: 1. Shelving 2. Exterior of bulk ingredients container. Corrective Actions: Clean the surface at a frequency necessary to preclude accumulation of soil residues that become encrusted or attract insects and rodents.
- Dual check backflow preventer is required at the water line connected to the hot water /coffee machine . Person in charge was unable to provide information if a internal backflow prevention device is inside the equipment. EHS provided a handout to the person in charge. Corrective Actions: A plumbing system shall be installed to preclude backflow of a solid, liquid, or gas contaminant into the water supply system at each point of use at the food establishment, including on a hose bibb (threaded faucet) if a hose is attached or on a hose bibb if a hose is not attached and backflow prevention is required by law by.Installing an approved backflow prevention device .

- The person in charge was unable to provide proof of employees being trained on the big 6 foodborne illnesses and their symptoms. A sample copy was provided to the person in charge to be reviewed, signed, and dated by all employees. Corrective Actions: All employees must be trained on the big 6 foodborne illnesses (Salmonella typhi, non-typhoidal Salmonella, Shigella, Escherichia coli, Hepatitis A, and Norovirus) and their common symptoms.
- The person in charge was unable to provide written procedures for the clean-up of vomit and diarrhea. A sample copy was given to the person in charge. Corrective Actions: Provide written procedures for the clean-up of vomiting and diarrheal events.
- The inside of the microwave was soiled. Corrective Actions: Clean the inside of the microwave at least every 24 hours.
- Time as a public health control is used for the sushi rice. It is not labeled with the time that it should be discarded (4 hours). The sushi rice was at 138°F when I took the temperature. The time that the rice should be discarded was written down (3:00pm). Corrective Actions: Label foods that time is being used for so that it will be discarded after the 4 hour time limit.
- Reduced oxygen packages (ROP) of tuna were in the reach-in cooler to thaw while the package was still closed. The tuna was still frozen (29°F). The packages were all cut open and returned to the reach-in cooler to be thawed. Corrective Actions: Reduced oxygen packaged fish that bears a label indicating that it is to be kept frozen until time of use shall be removed from the reduced oxygen environment: 1. Prior to its thawing under refrigeration.
- Observed the outside doors of the reach-in freezers and the area around the first kitchen hand sink soiled. Corrective Actions: Clean non-food contact surfaces as often as necessary to keep them clean.

- Observed employee who was wearing gloves, crack open some eggs, then change gloves without hand washing, then continue to cook. Person in charge told employee to wash their hands after cracking eggs and before changing gloves. Corrective Actions: Food employees shall clean their hands and exposed portions of their arms immediately before engaging in food preparation, as often as necessary to remove soil and contamination and to prevent cross contamination when changing tasks, when switching between working with raw foods and working with ready-to-eat foods,and before donning gloves to initiate a task that involves working with foods.
- The following foods were observed cold holding at improper temperatures in the cook's prep unit: 1- feta cheese (50'F), 2- bleu cheese (50'F), sliced provolone cheese (49'F) and shell eggs (50'). All items had been held in the unit overnight. Items were voluntarily discarded during inspection. New items were placed in the prep unit on ice and a service call was made during inspection.
- Corrective Actions: Cold hold time/temperature control for safety foods at 41 F or below to inhibit the growth of harmful bacteria.
- Observed two employees preparing food without beard guards. Beard guards were donned during inspection. Corrective Actions: Food employees shall wear hair restraints such as hats, visors, hair nets or beard nets to effectively keep their hair from contacting exposed food, clean equipment, utensils, linens, and unwrapped single-service items. This section does not apply to food employees such as counter staff who ONLY serve beverages and wrapped or packaged foods, hostesses, and wait staff.
- The following non-food contact items were observed soiled: 1-the bottom of both convection ovens, 2-the side of the ovens (heavy layer of grease and oil from deep fryer). Corrective Actions: Clean the surface at a frequency necessary to preclude accumulation of soil residues that become encrusted or attract insects and rodents.

- Observed absence of active managerial control during the inspection. The person in charge is not monitoring the following: 1. Ensuring correct food grade sanitizer is used on food contact equipment. 2. Employees monitoring of food temperatures during reheating for hot holding. 3. Monitoring temperatures of TCS foods during cold holding. 4. Labeling of chemical spray bottles. Corrective Actions: Ensure the designated person in charge (PIC) is knowledgeable about foodborne disease prevention, Hazardous Analysis Critical Control Point principles and Regulation requirements. The PIC should be prepared to recognize conditions that may contribute to foodborne illness. The PIC must also recognize conditions that fail to comply with Regulation requirements and be authorized to take the appropriate preventive and corrective actions to ensure that the Regulations' objectives are fulfilled.
- During the inspection, the only food employee conducting activities in the breakfast service area could not communicate correct time and temperature requirements for reheating for hot holding, communicate testing of sanitizers and explain correct cleaning and sanitizing procedures for food thermometers. Education and demonstration of cleaning and sanitizing of food thermometers and testing of Chlorine sanitizer was provided. Corrective Actions: Based on the risks inherent to the food operation, during inspections and upon request the person in charge shall demonstrate to the regulatory authority knowledge of foodborne disease prevention, application of the hazard analysis and critical control point principles, and the requirements of this Code. The person in charge shall demonstrate this knowledge by responding correctly to the inspector's questions as they relate to the specific food operation. The areas of knowledge include describing foods identified as major food allergens and the symptoms that a major food allergen could cause in a sensitive individual who has an allergic relation.
- The person in charge could not provide documentation of an employee in a management or supervisory position who is a certified food manager. Certified food handler certificate was observed. The facility uses time as a public health control for waffle batter. Corrective Actions: By July 1, 2018 at least one employee with supervisory and management responsibility and the authority to direct and control food preparation and service must be a certified food protection manager who has demonstrated proficiency of required knowledge and information by passing a test that is part of an accredited program as specified in 12VAC5-421-65. - The only employee conducting breakfast food service operations was informed of symptoms and illnesses requiring reporting but has not signed the employee health policy posted. During the inspection Environmental Health staff provided training and the employee signed the employee health policy. Corrective Actions: The person in charge is responsible for ensuring that food employees and conditional employees are trained and aware of their responsibilities with regards to reportable symptoms, exposures, and diagnosis.
- Observed uncovered coffee grinds stored inside a coffee filter in the small storage room off of the dining room. Observed small flying insects in the vicinity. Coffee grinds were covered during the inspection. Corrective Actions: Foods shall be protected from contamination by being stored in packages, covered containers or wrappings unless being cooled.
- Observed interior of the microwave oven soiled. Corrective Actions: The cavities and door seals of microwave ovens shall be cleaned at least every 24 hours by using the manufacturer's recommended cleaning procedure.
- Observed single use containers of yogurt cold holding between 43-44 degrees F in the small reach in cooler in the dining room. The operator reported yogurt was placed in the refrigeration unit at 6:30 a.m. and yogurt were relocated to the refrigerator in the storage room to lower to 41 degrees F or less by 10:30 a.m. Temperature of the unit was lowered and observed at 36 degrees at the end of the inspection. Corrective Actions: Cold hold time/temperature control for safety foods at 41 F or below to inhibit the growth of harmful bacteria.
- Observed unlabeled chemical spray bottle in the warewashing area. During the inspection the person in charge reported the product was Fabuloso and labeled the spray bottle.Corrective Actions: Working containers used for storing poisonous or toxic materials such as cleaners and sanitizers taken from bulk supplies shall be clearly and individually identified with the common name of the material.
- The person in charge provided 2 bi-metallic stem thermometers with a sensor half-way up the shaft. A thin probed food thermometer is required to monitor internal temperatures of thin massed foods. Corrective Actions: A temperature measuring device with a suitable small-diameter probe that is designed to measure the temperature of thin masses shall be provided and readily accessible to accurately measure the temperature in thin foods such as meat patties and fish fillets.
- Observed presence of multiple small flying insects in the small storage room off of the dining room. Contact pest control for food service. Corrective Actions: Inspect premises on routine basis for the evidence of pests. . Insects and other pests are capable of transmitting disease to man by contaminating food and food-contact surfaces.
- Observed 4 missing ceiling tiles in the warewashing area and numerous ceiling tiles which are not sealed to the frame in the male and female toilet rooms. Corrective Actions: Protect the food establishment against the entry of insects and rodents by 1. Filling or closing holes and other gaps along floors, walls, and ceilings, 2. Closed, tight fitting windows, and 3. Solid, self-closing, tight-fitting doors.
- Observed single use spoons and forks and wooden coffee stirrers stored with the food contact surface facing upward. Single use spoons and forks were inverted to protect from contamination. Discussed purchase of pre-wrapped wooden stirrers. Corrective Actions: All single use and single service items should be presented so that only the handles are touched by employees or by self service customers. Lip contact surfaces should have original individual wrapper intact.
- The facility uses Chlorine bleach sanitizer and could not provide a valid test kit. A Quat and expired (Jan 2024) Chlorine test kit were observed. During the inspection a sample Chlorine test kit were provided, and the operator took a picture of the color key. Corrective Actions: Obtain a Chlorine test kit so that employees can accurately monitor the concentration of the sanitizing solutions and maintain them at a safe and effective level.
- Upon arrival to conduct the inspection the facility had low-splash bleach to sanitize food contact equipment which is not approved for food contact equipment. During the inspection Chlorox Performance Bleach was obtained which is food grade/safe. Corrective Actions: Except for chemical sanitizers that are generated on site at the time of use, chemical sanitizers that are used to sanitize equipment and utensils shall be provided and available for use during all hours of operation.
- Observed accumulation of debris on the following nonfood contact surfaces: 1. Reach in refrigeration unit in small storage room in the dining room - gasket and seal around the door. 2. Base of reach in refrigeration units in the dry storage area 3. Upsplash of coffee machine 4. Shelving above the 3-compartment sink. Corrective Actions: Nonfood-contact surfaces of equipment shall be kept free of an accumulation of dust, dirt, food residue, and other debris.
- Observed porous and absorbent ceilings which are not cleanable above food service areas in the dining room (waffle and hot holding service areas). Corrective Actions: Materials for indoor floor, wall, and ceiling surfaces under conditions of normal use shall be: 1. Smooth, durable, and easily cleanable for areas where food establishment operations are conducted, 2. Closely woven and easily cleanable carpet for carpeted areas and 3. Nonabsorbent for areas subject to moisture such as food preparation areas, walk-in refrigerators, warewashing areas, toilet rooms, mobile food establishment servicing areas, and areas subject to flushing or spray cleaning methods.
- Observed the following areas in need of cleaning: 1. Window/windowsill in the dry storage room. 2. Walls by 3 compartment sink 3. Floors in the warewashing area and small storage room by the dining room. Corrective Actions: Clean the physical facilities at a frequency necessary to ensure the protection and safe preparation of food.

What Violations Do VDH Inspectors Report?
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.
Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation.Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
