Raw Beef Stored Above Ready-To-Eat Food: Fredericksburg Inspections
Rappahannock Area Health District inspectors visited 20 Fredericksburg food establishments between Feb. 28-March 7.
FREDERICKSBURG, VA — Rappahannock Area Health District inspectors reported finding a total of 30 violations at nine of the 20 Fredericksburg food establishments they visited between Feb. 28-March 7.
In one kitchen, an inspector observed raw beef in boxes on top of boxed onions and next to boxed green peppers and Craisins in the walk-in cooler. As a corrective action, the raw beef was relocated to the bottom shelf while the ready-to-eat foods were stacked on the shelves above.
At another Fredericksburg restaurant, an inspector noted that the interior of the raw chicken reach-in coolers needed to be cleaned.

"Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues," the inspector wrote in their report.

Corrective Actions: Except when dry cleaning methods are used as specified under 12VAC5-421-1810, surfaces of utensils and equipment contacting food that is not time/temperature control for safety food shall be cleaned: 1. At any time when contamination may have occurred.
- Observed the in-use sanitizer in the 3comp sink at 0ppm. The tubing seemed to not be dispensing the sanitizer properly. Sanitizer was re-made manually and read 200 ppm. Corrective Actions: Utensils and food-contact surfaces of equipment shall be sanitized before use after cleaning.
- Observed stainless steel containers in the ware wash area wet while stacked. Corrective Actions: After cleaning and sanitizing, equipment and utensils: 1. Shall be air dried or used after adequate draining as specified in 40 CFR 180.940 before contact with food. 2. Shall not be cloth dried except that utensils that have been air-dried may be polished with cloths that are maintained clean and dry.
- Observed water accumulated at the bottom interior of the reach in cooler on the cookline. Corrective Actions: Equipment shall be maintained in a state of repair.
- Observed the cutting boards heavily scratched. Corrective Actions: Nonfood-contact surfaces of equipment that are exposed to splash, spillage, or other food soiling or that require frequent cleaning shall be constructed of a corrosion-resistant, nonabsorbent, and smooth material.
- Observed the top exterior of the grease receptacle in need of cleaning. Corrective Actions: An outdoor storage surface for refuse, recyclables, and returnables shall be constructed of nonabsorbent material such as concrete or asphalt and shall be smooth, durable, and sloped to drain.

- Absence of handwashing signage at all handwashing sinks. Sample signage emailed to the person in charge. Corrective Actions: A sign or poster that notifies food employees to wash their hands shall be provided at all handwashing sinks used by food employees and shall be clearly visible to food employees.
- After three cycles, observed the low temperature dishwasher sanitizing between 0-10 ppm at 120 degrees F. The dishwasher was not in use during the inspection. Instructed the person in charge to set up and use the 3 compartment sink to wash, rinse and sanitize equipment until the dishwasher is serviced by a technician. Corrective Actions: Chlorine sanitizer shall have a concentration of 50-100 ppm.
- Observed two scratched and scored green cutting boards. Corrective Actions: Surfaces such as cutting blocks and boards that are subject to scratching and scoring shall be resurfaced if they can no longer be effectively cleaned and sanitized or discarded if they are not capable of being resurfaced.
- Observed 3 scorched and chipped rubber spatulas and one cracked plastic food storage container. Utensils were removed during the inspection. Corrective Actions: Utensils shall be maintained in a state of repair or condition that complies with the requirements specified under Articles 1 (12VAC5-421-960 et seq.) and 2 (12VAC5-421-1080 et seq.) of this part or shall be discarded.
- Observed accumulation of debris on the following nonfood contact surfaces: Range, shelving in the walk-in cooler, shelving above the range, base and wire racks inside the oven. Corrective Actions: Nonfood-contact surfaces of equipment shall be cleaned at a frequency necessary to preclude accumulation of soil residues.
- Observed the floors under equipment and walls throughout in need of cleaning. Corrective Actions: The physical facilities shall be cleaned as often as necessary to keep them clean.
- Observed 22-foot candles of light at the cookline and two burned out shielded lights above the hood. Corrective Actions: At least 50-foot candles (540 lux) at a surface where a food employee is working with food or working with utensils or equipment such as knives, slicers, grinders, or saws where employee safety is a factor.

- The person in charge was unable to provide proof that at least one employee is a certified food protection manger. Corrective Actions: The person in charge will have at least one employee take the course.
- The following time/temperature control for safety (TCS) foods were being held above 41°F: In the two-drawer cooler there was 1) one bacon quiche at 43°F; 2) one spinach quiche at 42°F; and 3) one bag of raw shrimp at 44°F. In the prep cooler there was 1) four pints of heavy whipping cream at 45-47°F; and 2) one gallon of whole milk half full at 43°F. Corrective Actions: All TCS items were discarded.
- Observed the painted wood shelving units in the dry storage area are rough to the touch. Corrective Actions: The person in charge will have them repainted with at least an eggshell paint so that they are smooth and easily cleanable.
- There is no air gap at the three-compartment sink. Corrective Actions: Provide an air gap after the sanitization basin, but before the grease trap.
What Violations Do VDH Inspectors Report?
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.
Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
