Shake Machine Not Properly Sanitized At Fredericksburg Eatery: Report
Rappahannock Area Health District inspectors reported finding violations at eight of the 19 restaurants they visited between March 8-17.
FREDERICKSBURG, VA — Rappahannock Area Health District inspectors reported finding a total of 27 violations at eight of the 19 Fredericksburg food establishments they visited between March 8-17.
At one restaurant, the health inspector learned that the shake spindle was only cleaned and sanitized once a day. The inspector told the person in charge to wash and sanitize the spindle at least once every 4 hours to prevent contamination by bacterial growth.

- The person in charge was unable to provide proof that at least one person has a certified food protection manager (CFPM) certificate. Corrective Actions: The person in charge advised one manager is in the process of getting a CFPM certificate.
- Time as a public health control (TPHC) is being used for the following items for the continental breakfast which is 0630-0900: 1) cut melons (47°F); 2) yogurt cups; 3) nonfat milk cartons; 4) hard boiled eggs (shell removed) (56°F); and 5) milk, half & half, and 2% milk for coffee. Corrective Actions: The person in charge advised they do throw all items out after the breakfast service. I recommend putting out less of each item. TPHC form has been filled out by Environmental Health Specialist (EHS) and signed by EHS and the person in charge.
- The person in charge was unable to provide a valid test kit for the quaternary ammonium sanitizer at the tree-compartment sink (QT-40). Corrective Actions: A sample amount of test strips was given to the person in charge to use until a valid test kit is obtained.

- The light in the walk-in freezer was measured with a light meter at 0.9-13.0 fc. The two main lights in the unit were mostly off but flickering on periodically. The emergency light at the front of the unit was on. Corrective Actions: The person in charge advised that there is already a work order in to fix the lights.

- Facility does not have at least one food employee with a certified food protection management certificate. Corrective Actions: At least one employee with supervisory and management responsibility and the authority to direct and control food preparation and service shall be a certified food protection manager, demonstrating proficiency of required knowledge and information through passing a test that is part of an accredited program.
- Observed water at the hand sink not reaching adequate temperature in the kitchen. Facility called a technician for service. Corrective Actions: A handwashing sink shall be equipped to provide water at a temperature of at least 100°F (38°C) through a mixing valve or combination faucet
- Observed no soap at the handsink. Soap was placed at the handsink. Corrective Actions: Each handwashing sink or group of two adjacent handwashing sinks shall be provided with a supply of hand cleaning liquid, powder, or bar soap.
- Observed the test strips for chemical sanitizer expired. Corrective Actions: A test kit or other device that accurately measures the concentration in mg/L (ppm) of sanitizing solutions shall be provided and readily accessible for use.

- Observed an employee washing a spoon at the hand washing sink. Employee was instructed to wash the spoon at the three compartment sink (corrected on site). Corrective Actions: A handwashing sink shall not be used for purposes other than handwashing
- Through discussion with the food employee the shake machine spindle, which is in contact with the ice cream (contains milk) is not properly sanitized every 4 hours. Wash, rinse and sanitize step is conducted once a day. Instructed the person in charge to wash and sanitize the spindle at least once every 4 hours. Corrective Actions: Food contact surfaces of equipment and utensils must be cleaned and sanitized at least every 4 hours to prevent contamination by bacterial growth.
- Observed a food employee washing two stainless steel container with soap then rinsing with water, failing to sanitize the items. Employee was instructed to properly sanitize the items (corrected on site). Corrective Actions: Equipment must be washed, rinsed, and sanitized.
- Observed several stainless steel containers stored on the shelving unit used for clean dishes near the warewashing area to be soiled to the touch and sight. Items were relocated to be washed and sanitized (corrected on site). Corrective Actions: Equipment food-contact surfaces and utensils shall be clean to sight and touch.
- Observed the following time/temperature control for safety (TCS) foods cold holding at improper temperatures overnight at the prep unit: 1) a container of shredded cheese ( 55 degrees F) stored on the top- 2) a container of hot dogs (55 degrees F) stored on the bottom shelf. Items were discarded (corrected onsite) Corrective Actions: Cold hold potentially hazardous food at 41°F or below to inhibit the growth of harmful bacteria.
- Observed stainless steel food containers stacked while wet after sanitizing on the warewashing shelving units near the 3 compartment sink. Discussed requirements with the person in charge. Containers were relocated to be washed, sanitized, and properly dried. Corrective Actions: After cleaning and sanitizing, equipment and utensils shall be air-dried or used after adequate draining before contact with food.
- Observed uncovered disposable spoons stored in a soiled container in the front of the house with the lip contact surface facing different directions. Spoons were discarded. Person in charge will obtain wrapped spoons (corrected on site). Corrective Actions: Single-service and/or single-use articles shall be handled, displayed, and dispensed so that contamination of the food- and lip-contact surfaces is prevented.
- Observed leak under the beverage dispensing unit in the front of the house. Corrective Actions: Equipment must be maintained in good repair.
- Accumulations of debris were noted on the following non-food contact surfaces: 1) exterior of the ice machine, 2) exterior and interior of the cold holding units (including 2 not in use), 3) hot holding unit 4) exterior of the beverage dispensing unit, 5) shelving unit, 6) cabinets near drive thru area, 7) milk shake dispensing unit, 8) fryer station. Corrective Actions: Clean nonfood-contact surfaces of equipment at a frequency necessary to preclude accumulation of soil residues.
- Observed refuse stored outdoor directly on the ground near the dumpster. Corrective Actions: refuse must be stored in receptacles or waste handling units so that they are inaccessible to insects and rodents.
- Observed open ceiling above the beverage dispensing unit in the front of the house. Observation was discussed with the person in charge on January 21, 2024. Corrective Actions: Refinish or replace the ceiling in the toilet rooms so it is: (1) Smooth, durable, and easily cleanable for areas where food establishment operations are conducted; (2) Closely woven and easily cleanable carpet for carpeted areas; and (3) Nonabsorbent for areas subject to moisture.
- Observed the walls, floors, and ceiling tiles throughout the facility in need of cleaning. Corrective Actions: All floors, walls, and ceilings must be cleaned as often as necessary to keep them clean. Cleaning of the physical facilities is an important measure in ensuring the protection and sanitary preparation of food. A regular cleaning schedule should be established and followed to maintain the facility in a clean and sanitary manner.

What Violations Do VDH Inspectors Report?
Violations at restaurants typically focus on factors that can contribute to food contamination. The local health department can also perform a re-inspection to ensure that possible violations have been corrected.
Sometimes, the follow-up inspection only considers the most important "priority" violations.For every observed violation, the inspector provides a specific corrective action that can be completed to rectify the violation. Sometimes these are simple, and violations can be corrected during the course of the inspection.
Depending on the results of the inspection, the health department can pursue several actions. It can issue a permit for the restaurant to continue serving food, they can schedule a follow-up inspection to determine if violations have been rectified, or officials can temporarily shut down an establishment until certain issues are solved.
The Virginia Department of Health only recommends restaurants have their permits suspended when "the continued operation of the foodservice presents a substantial and imminent threat to the public health."
