No Charges in Serious Bicycle Wreck in Alexandria

Evidence in case doesn't support criminal prosecution, says Commonwealth's Attorney's Office.

ALEXANDRIA, VA — The driver in a May 5 wreck that seriously injured a bicyclist will not face charges, according to the Commonwealth's Attorney's Office.

Ryan Brown was struck while riding home from work in the area of Duke Street and West Taylor Run Parkway.

The last public update from friends of the Brown family noted that he was breathing on his own, as of May 23, and leaving the Intensive Care Unit.

In declining criminal charges, Commonwealth's Attorney Bryan Porter said the 80-year-old driver involved in the case remained at the scene and she has cooperated with investigators.

"As a prosecutor, I must make charging decisions that are consistent with the evidence in the case and the applicable standards of proof that are required under the criminal law," Porter wrote in a statement. "These horrible situations are often referred to as accidents for the simple reason that their occurrence is not intended by either person involved."

He said the driver did not act in a criminally negligent manner, but stressed that his determination does not prevent a civil case involving the wreck.
