Sutherland was initially charged in 2019, after DNA evidence revealed that he was the father of a child born to a patient at Hacienda Healthcare, an intermediate care facility. All of the men who worked at the facility were DNA tested.

Workers at the facility didn't know the woman was pregnant until she gave birth in 2018.
