Solano County's Eviction Protections Remains In Effect After State Protections End; No Scheduled Termination Date
Solano County's moratorium on evictions for non-payment of rent by tenants directly impacted by the COVID-19 pandemic is still in effect.

SOLANO COUNTY, CA — Solano County’s Emergency Regulation establishing a temporary, countywide moratorium on evictions for non-payment of rent by residential or commercial tenants directly impacted by the COVID-19 pandemic is still in effect.

The State of California’s emergency tenant protections against eviction for non-payment of rent ended June 30th. However, Solano County’s Emergency Regulation is separate from the State’s protections and is not tied to the June 30 expiration date. The County’s protections will remain in effect as long as the Governor’s State of Emergency continues, and for 90 days after it terminates. The State of Emergency currently remains in effect with no scheduled termination date.
The Regulation, adopted by the Board of Supervisors on April 28, 2020, provides that a landlord may not file an unlawful detainer, an important step in starting the eviction process, for non-payment of rent and/or late fees that became due during the State of Emergency and for a period of 90 days after the State of Emergency ends if the tenant was unable to pay the rent because of a substantial reduction in household income or a substantial increase in expenses resulting from the COVID-19 pandemic. The Regulation does not relieve any residential or commercial lessee or tenant of liability for unpaid rent.

The Regulation also allows a tenant to terminate a lease or rental agreement with 30 days’ notice without penalty if the tenant has cause for termination that is related to the COVID-19 pandemic.
