Man Who Allegedly Exchanged Gunfire With San Jose Cop Held On $1 Million Bail

A 29-year-old man who allegedly exchanged gunfire with a police officer on Sunday was arraigned in a San Jose courtroom on Wednesday.

SANTA CLARA COUNTY, CA -- A 29-year-old man who allegedly exchanged gunfire with a police officer in East San Jose on Sunday morning was arraigned in a San Jose courtroom Wednesday afternoon.

Kevin Riley, of San Jose (pictured above), was charged with three counts of attempted murder of a police officer and possession of a stolen firearm. Each attempted murder count carries an enhancement for the use of a firearm, prosecutor Tracy Tefertiller said in court today, adding up to a $1 million bail amount.

Riley, who did not enter a plea, is being represented by a public defender and is scheduled to appear in court again on May 31.

Thomas Barnard, the 16-year veteran officer who fired at Riley, was placed on routine paid leave following the shootout. No one was harmed by the shots fired, according to police. Barnard and other officers responded around 8 a.m. to a report of a suspicious, armed person in the 2200 block of Tully Road near the Reid-Hillview Airport.

Riley is alleged to have pulled out a .45-caliber pistol and fired at officers when they gave him commands. It was then that Barnard fired back, police said. Riley allegedly ran from the officers and hopped a fence into a nearby mobile home complex. Police set up a perimeter and then found Riley and the gun shortly after.

The gun was determined to have been stolen in 2013, police said.

Riley is being held in the Santa Clara County Main Jail. The incident comes days after two fatal officer-involved shootings by San Jose police, one of which also took place in East San Jose.
