Police Fatally Shoot Man After Domestic Stabbing

SAN JOSE - A man allegedly stabbed his estranged wife and another person in a domestic violence incident Monday evening in San Jose before he was fatally shot by an officer, police said Tuesday.

The suspect, who hasn't been identified, was separated from his wife and the second victim was her acquaintance, police Chief Eddie Garcia said at a news conference.

The San Jose officer, who happened to be nearby, responded to the stabbing reported in the area of South Third and Martha streets around 6:15 p.m. and arrived within seven seconds of the call, Garcia said.

Upon arriving to the "chaotic" scene outside a home, the officer saw the woman laying face down on the ground amid multiple witnesses, one of whom identified the suspect.

Witnesses were unsuccessful in their attempts at subduing the suspect, the chief said.

The suspect faced the officer in a "very aggressive manner" while armed with a knife, then turned around and walked back toward the residence, where a female was seen exiting through the front, Garcia said.

The suspect turned back and looked at the officer many times while heading back to the home, according to the chief.

The officer ordered the suspect to drop the knife, then fired his weapon at the suspect when the armed man didn't comply, Garcia said.

The suspect was pronounced dead at the scene.

The estranged wife was taken to a hospital for treatment and was later released.

The second victim, an unidentified man, was later located outside the home and remains at a hospital in critical condition, but is expected to survive, police said.

Investigators have learned there was a temporary restraining order between the separated couple, but Garcia said he didn't have specifics on the arrangement.

There was a previous domestic violence call at the home in December in which the husband was also a suspect, according to police.

No body-worn cameras captured footage of the shooting, Garcia said.

The officer, who hasn't been named, was placed on routine paid administrative leave while homicide detectives look into the shooting, according to Garcia.

The city's independent police auditor and the Santa Clara County District Attorney's Office are monitoring the police investigation, Garcia said.
