SJ Fatal Victim Shot Accidentally By Cousin Identified: Police

Despite the incident deemed an alleged accident, the cousin was booked into Santa Clara County Jail and is accused of murder.

SAN JOSE, CA — A man who was allegedly shot and killed accidentally by his cousin last week in San Jose was identified by the Santa Clara County medical examiner's office Wednesday as 25-year-old Isaac Gutierrez of Salinas.

Gutierrez was at the home of 21-year-old Robert Ornelas in the 300 block of Blossom Hill Road on April 21 when Ornelas shot him in the groin while playing around with a firearm, according to court documents.

Ornelas called police at 12:42 a.m. and told them that Gutierrez had accidentally shot himself. An investigation found that Gutierrez had initially pointed the gun at Ornelas and pulled a trigger, but the gun didn't go off.

According to court documents, Ornelas then grabbed the gun from him to "f--- with him back," but the gun fired when he pointed it at his groin. He told another witness at the home that he wasn't aware the safety lock was off, and said, "I f---ed up! I f---ed up! It was an accident!"

Gutierrez walked out of the room and asked to be taken to the hospital, saying "Robert accidentally shot me," according to court documents. He was transported to Kaiser Permanente San Jose Medical Center, where he died about an hour later.

Ornelas was arrested and arraigned in Santa Clara County Superior Court last week. He has been charged with murder and is being held without bail in Santa Clara County Main Jail.

Friends and family of Gutierrez created a GoFundMe donation page at https://www.gofundme.com/in-lo... last week for his burial costs, partner and baby daughter. The page has raised almost $10,000 of its $15,000 goal as of Wednesday afternoon.
