Jury Deliberations Begin For Former Danville Coach Accused Of Sending Lewd Photos To Teens: Reports

Former SRVUSD teacher and coach Nicholas Moseby claimed he meant to send the photos to adult webcam models.

DANVILLE, CA — The jury began deliberations following the six-week trial of Nicholas Moseby, a former Danville biology teacher and cheerleading coach accused of sending lewd photos to a 14 and 15-year-old.

Moseby was arrested in September 2022 on accusations of sending a nude photo of himself to the two girls, whom he had coached at the cheerleading school Norcal Elite in San Ramon. Since then, more alleged victims have come forward, and Moseby now faces multiple felony charges, including two acts of committing a lewd act upon a child, one count of distributing or showing pornography to a minor, and additional charge of sexual battery, according to the Contra Costa County District Attorney’s Office.

He has pleaded not guilty to all charges.

Over the course of the trial, several students alleged a pattern of inappropriate behavior from Moseby, including groping, sexual remarks, and inappropriate messages. A Diablo Vista Middle School student even alleged that Moseby rubbed against her while he was substituting her physical education class and ejaculated onto her shirt, according to a report in Danville San Ramon. The shirt was analyzed by a forensics lab, which did not detect the presence of semen in preliminary testing and did not pass the item along for further testing. Still, Contra Costa County Deputy District Attorney Jessica Murad noted the possibility of a false negative.

Moseby admitted to sending the video, though he claimed he meant to send it to an adult webcam model, not the 15-year-old student, according to numerous reports. “I was horrified,” he claimed.
Prosecutors rejected this explanation, arguing that Moseby used his position as a teacher and coach to groom underage girls. “Position of trust. Position of power. Abused for his own sexual pleasure,” Murad said in her closing statement.

She noted that Mosesby’s internet search terms include terms like “teens,” “bubble booty,” and “high school.” Moseby was also involved in at least three criminal prosecutions before he was hired at SRVUSD. He was accused of providing alcohol to a teen in 2009, public intoxication in 2010, and answering an ad for a sex worker in 2015. He also admitted to engaging in a sexual relationship with a senior in high school in Arizona, though he has maintained that she was 18. He is also accused of sending another sexual photo to an 18-year-old student. Moseby said that he was not fired from any of his jobs in Arizona, according to Danville San Ramon.

Defense attorney Manisha Daryani accused the prosecution of making “baseless claims”, and prosecuting “non-criminal behavior,” according to a report from the Bay Area News Group. She also said that most of the other alleged victims only came forward after the initial charges against Moseby were announced.

Moseby worked as a biology teacher at San Ramon Valley High School before transferring to Diablo Visa Middle School. Reports claim that students had filed complaints about his behavior as early as 2021, and SRVUSD transferred him without public explanation. Former SRVUSD Superintendent John Malloy said that the school is reviewing “every aspect of our own hiring practices to add additional layers of backgrounding which may not be required by law, but in my opinion, are an absolute must in order to be certain that something like this never happens again.”
