City Attorney to Weigh in on School District Tax

An opinion is to be prepared by the attorney regarding legality of possible tax to benefit solely Hermosa Beach schools.

The Hermosa Beach school board increase as a solution to raising revenue for the financially strapped Hermosa Beach City School District.

But what are the legalities surrounding a sales tax measure specifically benefitting public schools?

City Attorney Michael Jenkins is scheduled to offer a legal opinion on the matter in a City Council meeting Tuesday (see accompanying city staff report under photo.)

In an October school board meeting, the board voted 3-1 to request that the city attorney look into the legality of possibly putting a , which would benefit the school district, on an election ballot for a residential vote.

"There is some confusion in the state as to the legality of sales tax measures," said Superintendent Bruce Newlin at the board meeting.

He wrote a letter to the city asking for an analysis on the proposed measure.
