Repeat ADA Lawsuit Filer Strikes San Ramon Business, 39 Others in Bay Area

A well-known disability code violation attorney reportedly wants a $25,000 settlement for $300 in quick fix complaints.

SAN RAMON, CA- Serial ADA violation lawsuit filer Scott Johnson struck a family-owned gas station in San Ramon this past November, and despite the owner’s quick fixes, is still demanding a $25,000 settlement, according to Mercury News.

Mercury News reports, San Ramon Valero owner, Sameer Misson, found out that his business was being sued for disability access violations he did not realize were out of compliance.

Mission reportedly made the required changes quickly, going beyond requirements and hiring a specialist to certify that the service station on San Ramon Valley Boulevard was up to code.

The Americans with Disabilities Act code violation complaints reportedly cost the business owner approximately $300 to repair and included:

  • Handicap parking striping and signage
  • Door pressure changes
  • Changes to the counter height
  • A new bathroom sink

However, the wheelchair-bound attorney and owner of Disabled Access Prevents Injury Inc. is still demanding a $25,000 payment, reports Mercury News.

Johnson, known for filing and winning thousands of ADA lawsuits in the Sacramento area, appears to be moving his focus to the East and South Bay.

Since October, Johnson has reportedly sued 39 businesses including from San Ramon, San Jose, Campbell, Pacheco and Pleasant Hill, says Mercury News, with five of them paying out confidential settlement amounts.

Mercury News reports:

Each violation, even if it involves a sign affixed to a door an inch too high or low, can carry a $4,000 civil penalty, but more importantly, the loser must pay the other party's legal fees. And the longer the case drags through court, the bigger the bill, so many businesses choose to settle.
