The March 15 meeting will start at 6 p.m. in Council Chambers in City Hall, which is located at 2006 Heritage Walk. People can attend in person or watch live online at https://www.youtube.com/watch?v=5g97Ru8z0rw.

The Board of Zoning Appeals (or BZA) is a quasi-judicial body that hears variance requests as well as appeals to City decisions related to zoning ordinances, stream buffers, and sign permits. Its votes must be guided by City Code, including its zoning standards. BZA decisions can be appealed to Fulton County Superior Court.

The first primary variance request on the March 15 agenda relates to 335 COX ROAD, home of the Union Primitive Church near where Cox intersects with Ebenezer and Etris roads. That item, however, is being administratively deferred – meaning that it will not be considered at Tuesday’s meeting.

But the second request, for a flag lot at 13651 NEW PROVIENCE ROAD, will be up for discussion. This AG-1 zoned property sits on 2.38 acres roughly opposite Mill Springs Academy.

The applicant is seeking to build an addition, fourth single-car garage. Doing so would encroach beyond the property’s currently allowed 50-foot rear setback. The request is for a variance for a 39.5-foot setback instead.

The City’s Design Review Board considered this matter earlier this year and recommended approval of the requested variance.

After Tuesday’s meeting, the Board of Zoning Appeals is next scheduled to convene the night of April 19.
