Residents Drop Suit Against City
Residents of one Dunwoody subdivision have dropped a suit against the city to halt construction of a trail through their neighborhood.
A lawsuit against the city to halt construction of a Brook Run Trail through the Brook Run forest has been dropped.
The residents of the Lakeview Oaks subdivision voluntarily dropped the suit, according to Reporter Newspapers.
The voluntary dismissing of the case comes after a state Supreme Court ruled 4-3 denying an emergency motion for an injunction filed by the lawyer for the subdivision's residents.

The motion was previously denied by a DeKalb County Superior Court judge in February while the lawsuit against the city was pending.
Lakeview Oaks resident Beverly Armento said the city broke the law by not studying the downstream effects of the first phase of the trail.

"We have decided to dismiss the lawsuit for now in order to see if the city will make good on its promise to look at the impacts of the entire trail on our subdivision and to make sure we are not flooded by Brook Run Park," Armento told the Reporter.
