Judge Temporarily Bans Crack Down On Cannabis Products In Gwinnett County: Reports

A judge said that Gwinnett County District Attorney Patsy Austin-Gatson can't stop smoke shops from selling cannabis extract products.

GWINNETT COUNTY, GA — A judge ruled that Gwinnett County authorities can’t ban smoke shops for selling what they say are illegal cannabis extracts, according to reports.

The judge issued a temporary restraining order for at least 30 days, reported WSB-TV.

Gwinnett County District Attorney Patsy Austin-Gatson and a task force have raided two distributors of products containing Delta 8 and Delta 10 THC over the past several weeks, reported the news station.

On Friday Fulton County Superior Court Judge Craig Schwall ordered the restraining order to prevent the district attorney from continuing to enforce her ban, reported the Atlanta-Journal Constitution.

“I have concerns that this may or may not be a rogue DA,” Judge Schwall told the AJC. “I think there may be some prosecutorial priorities misplaced.”

The lawsuit was filed last week by owners of two Gwinnett County vape stores, reported the AJC.

In a January news release, Austin-Gaston, who took office last year, said that possessing, selling or distributing the substances are felony offenses, reported the AJC.
