Smyrna Mother Sues Sheriff's Office After Newborn's Death

The is being sued by a woman who says inadequate medical care while in the jail led to her newborn baby's death.

According to the Marietta Daily Journal, Taylor Hogan, 24, of Smyrna delivered her baby in a bathroom in August 2010 while she was incarcerated on a charge of possession of stolen property. Her baby, whom she named Savante, died nine hours later.

The newspaper reports that Hogan alleges in the lawsuit, which she filed in U.S. District Court in Atlanta, that she received inadequate medical care before and after her baby's birth.

Hogan is seeking $10,000 from Wellstar Cobb, a physician who works there named Robert Nguyen and the Cobb County Sheriff's Office, MDJ reported.

Neither the county's attorney, Deborah Dance or the hospital's attorney, Lance Lorusso, are commenting on the lawsuit.

Jail records show that Hogan told the jail nurse on April 23 that she was 23 weeks pregnant and was put on "prenatal care" after taking a pregnancy test.

Less than three months later on Aug. 9, Hogan complained of cramps and Deputy Sheriff Lynda Stoker told her to lie down. Two hours later after "throwing up and crying" in a hallway, she was taken to an infirmary

The suit states that Hogan delivered her baby "prematurely and without assistance in the bathroom causing the baby to fall on the concrete floor head first" at approximately 12:55 a.m. Then the jail medical staff put the baby on top of Hogan "without even severing the umbilical cord and called an ambulance leaving the baby gasping for air with no assistance.”

Within an hour of delivery, Hogan was taken to Wellstar Cobb Hospital, where doctors told her the baby would not survive. She was allowed to have the baby with her until he died at approximately 10 a.m. the next day.

Hogan lives in Smyrna with her 1-year-old son, who was delivered at 25 weeks, the MDJ reports.

Hogan is also suing , which provides medical care at the jail.
